in each instance of application for such a <br /> permit , conduct a public hearing. Notice <br /> of said hearing shall be given by <br /> publication of the time and place thereof <br /> in a local newspaper not less than 7 days <br /> before the hearing and the expense of such <br /> publication shall be borne by the <br /> applicant . After such a hearing, the Board <br /> of Selectmen shall render a decision in <br /> writing stating the decision and the reason <br /> therefore , and shall file the decision with <br /> the Town Clerk and send a copy thereof to <br /> the applicant . In considering the <br /> application for a permit the Board of <br /> Selectmen shall take into account the <br /> general safety and wellbeing of the <br /> inhabitants of the Town , the rights of <br /> abutting property owners, and the benefit <br /> to be conferred upon the general public <br /> by the granting of the permit . Upon the <br /> filing of the application with the Board <br /> of Selectmen , . the applicant shall also <br /> give notice to the Chief of Police , the <br /> Chief of the Fire Department , the Board of <br /> Health and the Building Inspector , and the <br /> applicant shall submit proof to the Board <br /> of Selectmen at the hearing that notice has <br /> been duly given . The Board of Selectmen <br /> may impose such conditions as it deems <br /> appropriate for the protection of public <br /> safety and property. Any permit granted <br /> hereunder may be revoked by the Board of <br /> Selectmen for violation of any term or <br /> condition imposed by the permit . <br /> (Amended at Special Town Meeting, December <br /> 2, 1955, approved by Attorney General , <br /> February 11 , 1956) . Article 56. <br /> Section 4.5. 16 Enforcement and Provision for Handicapped <br /> Parking. <br /> a. Any person or body that has lawful <br /> control of a public or private way or <br /> of improved or enclosed property used <br /> as off-street parking areas for <br /> businesses, shopping malls, theaters, <br /> auditoriums, sporting or recreational <br /> facilities, cultural centers, <br /> residential dwellings, or for any other <br /> place where the public has a right of <br /> access as invitees or licensees, shall <br /> be required to provide reserve parking <br /> spaces in said off-street parking areas <br /> -63- <br />
