4 <br /> SECTION 4 : <br /> APPLICATION OF REGULATIONS <br /> 4. 1 No buildings shall be erected or used , and no land <br /> shall be used or di.vided unless in conformity with <br /> the regulations of this By-Law. All other buildings <br /> and all other uses of land or of buildings are hereby <br /> expressly prohibited , except those already lawfully <br /> existing which by the provisions of this By-Law <br /> become lawfully nonconforming . <br /> 4. 2 When a lot is transected by a zoning district <br /> boundary , and in part in the adjacent municipality , <br /> the provisions of this By-Law shall be applied to the <br /> portion .of such lot in the Town of Mashpee in the same E <br /> manner as if the entire lot were situated in Mashpee. <br /> 4.3 When a lot is transected by a zoning district <br /> boundary , the regulations of the By-Law shall be <br /> applicable to the larger part by -area of such lot <br /> may also at the option of the lot owner be deemed <br /> to govern in the smaller part beyond such zoning <br /> district boundary but only to an extent not more than <br /> thirty ( 30 ) linear feet in depth beyond such zoning <br /> district boundary . <br /> 4 .4 No building shall be erected except on a lot fronting <br /> on a street and there shall be not more than one <br /> principal building on any residential lot , except <br /> as allowed under this By-Law . For the purpose of adequate <br /> access to a parcel of land proposed for subdivision or <br /> division , there shall be required direct access from the <br /> parcel or lot to a paved Town , County or State road , or a <br /> street for which a road covenant has been released by the <br /> Planning Board , or a street having a right-of-way layout <br /> and construction meeting at least the mimimu.m layout width , <br /> pavement , drainage and other street requirements of the <br /> Mashpee Subdivision Regulations and Planning Board for <br /> subdivision streets . <br /> 4.5 Land within the lines of a street on which a lot abuts <br /> shall not be counted as part of such lot for the <br /> purpose of meeting the area requirements of this <br /> By-Law even though the fee to such land may be in the <br /> owners of abutting lots . r� <br /> 4.6 Any land taken by eminent domain , or conveyed for a <br /> public purpose for which the land could have been <br /> taken by eminent domain , shall not be deemed to be <br /> transferred , in violation of the land area , width , <br /> and space provisions of this By-Law . <br /> 4 - 1 <br />
