dwellings by the legal owner of any lot on January 1 <br /> of the previous year who has not received a permit for <br /> a new residence in Mashpee during the previous 24 <br /> months and who has documented in writing to the Build- <br /> ing Inspector his intention to be the exclusive <br /> resident on the premises for at least one year (resi- <br /> dence being defined as occupation by the members of one <br /> family for at least 30 days in said year with no <br /> occupation or rental by other persons during that <br /> period). <br /> Second- Provided that monthly and annual limits have not <br /> been exceeded, in the order of their receipt by the <br /> Building Inspector, one application in any month for a <br /> single-family dwelling by a licensed construction <br /> supervisor who has received no more than five (5) <br /> building permits for new residences in Mashpee in the <br /> previous twelve month period, except that, among such <br /> applications, structures not located within a Primary <br /> or Secondary Conservation Area shown on the most re- <br /> cently adopted Open Space Incentive Plan shall be <br /> approved first, then any others may be approved. <br /> Third - Provided that the monthly and annual limits have <br /> not been exceeded, permits for any dwelling units <br /> for which permits were applied in previous months <br /> but were not approved based on the provisions of <br /> Section 6.4 may be approved, in the order of their <br /> receipt by the Building Inspector, up to the monthly <br /> and annual limits, except that among such applications, <br /> structures not located within a Primary or Secondary <br /> Conservation Area shown on the most recently adopted <br /> Open Space Incentive Plan shall be approved first, then <br /> any others may be approved. <br /> Fourth- If after permits have been issued to all applicants <br /> i-n the first through third categories and the monthly <br /> and annual limits have not been reached, building <br /> permits may be issued to other applicants up to <br /> the limits, in the order of their receipt by the <br /> Building Inspector, except that structures not <br /> located within a Primary or Secondary Conservation <br /> Area shown on the most recently adopted Open Space <br /> Incentive Plan shall be approved first, then any <br /> others may be approved. <br /> 6.4.4.5 An application shall be considered received by the Building <br /> Inspector only if it is complete in all aspects, conforms with <br /> all applicable building codes and this Zoning By-Law, and has <br /> received all necessary approvals from the Board of Health, <br /> and, where necessary, the Board of Appeals and/or Conservation <br /> Commission. Upon receipt of any application, it shall be <br /> marked with the date and time of receipt. <br /> 6 - 19 <br />
