(d ) Are the proposed covenants , restrictions or <br /> deeds regarding the open space adequate to <br /> ensure its protection under the standards of <br /> this section and are they legally acceptable <br /> to the Town Counsel ? <br /> (e ) Is the proposal generally in conformance with <br /> the requirements and comments of the <br /> Conservation Commission , Board of Health , <br /> Design Review Committee and the other Town <br /> officials and agencies noted in Subsection <br /> 9 . 3 .2 . ? <br /> (f ) Should the development qualify for the full <br /> bonuses allowed by Subsection 9.3 .4 because it <br /> preserves critical open space and natural <br /> resource areas for the benefit of the <br /> inhabitants of the Town? ( Unless there are <br /> serious problems regarding the layout of the <br /> development , proposed or existing uses on or <br /> adjacent to the proposed open space , or <br /> serious potential adverse effects on public <br /> health , safety and welfare , open space which <br /> meets all of the requirements of Section 9. 3 . 3 <br /> should normally qualify for the full bonus <br /> allowed . ) ? <br /> (g ) Does the proposed development conform with the <br /> standards of Subsection 9 .3 . ? <br /> (h ) Will the project have a safe and adequate <br /> access to a road listed in Subsection 9 . 3 . 1 ? <br /> i <br /> ( i ) Have the location of structures , building <br /> heights and setbacks between buildings been <br /> approved (where required ) by the Fire Chief? <br /> (j )- Does the proposed development conform with the <br /> requirements of Subsection 9 . 3 . 6? <br /> (k ) Will the proposed development be superior to <br /> alternative plans in preserving open space for <br /> conservation and public recreation , in its use <br /> of the natural features of the land and in <br /> allowing for more efficient provision of <br /> public services? <br /> ( 1 ) Is the proposed .development in the best <br /> interests of the public health , safety and <br /> general welfare? <br /> 9 - 20 <br />
