No special permit for an OSID may be issued by the <br /> Planning Board unless the Board finds in the <br /> affirmative with regard to all of the above items . <br /> The Planning Board shall act regarding an OSID <br /> special permit application within ninety ( 90 ) days <br /> of the public hearing . Approval of the special <br /> permit shall require a four-fifths (4/5 ) vote of <br /> the Board . <br /> 9 .3 .7 .4 The Board may either approve the <br /> application as submitted , approve subject to <br /> modifications and conditions , or deny the <br /> application . If modified or denied , the Board <br /> shall include written reasons for such action in <br /> its decision . Unless an extension of time is <br /> requested in writing by the applicant , if the Board <br /> fails to make its decision within ninety (90 ) days <br /> from the public hearing the plan shall be deemed <br /> approved . However , no building permit shall be <br /> issued until the Special Permit , signed by the <br /> majority of the members of the Board , has been <br /> recorded in the Registry of Deeds and until any <br /> appeal period has passed . <br /> 9 .3 . 7 .5 If the project is denied , the developer <br /> shall not submit substantially the same proposal <br /> for two (2 ) years , except as provided under M. G. L. <br /> Chapter 40A, Section 11 . <br /> 9 . 3 .7 . 6 Contents of the Special Permit - If a <br /> special permit is approved by the Board , it shall <br /> include the following items : <br /> (a ) The Board ' s written findings regarding <br /> Subsection 9 . 3 .7.3 ; <br /> (b ) The Board ' s decision regarding the number of <br /> bonus residential units to be allowed , the <br /> total number of units to be allowed , and any <br /> commercial uses to be allowed ; <br /> (c ) Any other conditions imposed by the Board <br /> regarding the development , including any <br /> required road improvements , bonding , etc . ; <br /> (d ) A copy of the master site plan and phasing <br /> plan as approved for the development including <br /> all items required by Subsection 9 . 3 . 7.2 (c ) ; <br /> (e ) Copies of the approved covenants , restrictions <br /> and deeds to be recorded under Subsection <br /> 9 . 3 . 3 . 3 ; <br /> 9 - 21 <br />
