BOARD OF APPEALS Edward R. Hasil SP-90-44 2. <br /> 1. The Applicant must comply with all State, County and Town Health <br /> laws and municipal by-laws and regulations in the operation of <br /> the flea market. <br /> 2. The Board of Selectmen shall, at their discretion, require the <br /> applicant to provide a police officer during the hours of operation <br /> and at the applicant's expense, to control traffic and parking on <br /> the State layout of Route 28. The police officer will control <br /> on-site parking and the movement of traffic on and off the premises. <br /> 3. The hours of operation at the Flea Market shall be within 7:00 a.m. <br /> and 9:00 p.m. each day of operation except that vendors may perform <br /> necessary setup work from 6:00 a.m. to 9:00 a.m. <br /> 4. No structures of a permanent nature are to be constructed, erected, <br /> or caused to be placed on the property used in connection with <br /> the Flea Market. All structures, devices, equipment and other <br /> gear placed on the property for use in connection with the Flea <br /> Market are to be removed at the conclusion of each day's operation. <br /> 5. Up to 25 vehicles may be stored or left on the property between <br /> the hours of 9:00 p.m. and 6:00 a.m. of the following day in an <br /> area located behind Pickwick's Restaurant building as designated <br /> on the site plan. At no time are any vehicles, trailers, campers, <br /> tents, mobile homes, or other similar devices to be used for <br /> human habitation or sleeping during the hours of 9:00 p.m. to <br /> 6:00 a.m. <br /> 6. All parking shall be on-site. <br /> 7. No music is to be played over loudspeakers. <br /> S. The petitioner shall conform to and comply with the existing <br /> sign code, with prior approval from the Board of Appeals. <br /> 9. All displays, sales and flea market operations shall be located <br /> at the rear of the current site of the Mini-Golf and <br /> festaurant (currently known as Fabio's) . <br /> 10. The Applicant shall Constructs stockade fence shielding the <br /> dumpster or other trash disposal receptable and the farm tractor <br /> or any other equipment used in connection with the maintenance <br /> and conduct of the business, so that the same may not be seen <br /> from any road or from any abutting property. <br /> 11. The Applicant shall maintain the site to remove paper, garbage <br /> and other debris from the grounds and shall trim all excessive <br /> vegetation, meaning grass shall be mowed and landscaping <br /> maintained in a neat and orderly manner, and parking areas and <br /> routes of vehicle travel shall be maintained in a neat and hard <br /> packed appearance. The site shall be graded so as to maintain a <br /> level area pitched to drain away from abutting roads and property <br /> and to minimize the pooling of water.
