BOARD OF APPEALS Edward R. Hasil SP-90-44 2. 1. The Applicant must comply with all State, County and Town Health laws and municipal by-laws and regulations in the operation of the flea market. 2. The Board of Selectmen shall, at their discretion, require the applicant to provide a police officer during the hours of operation and at the applicant's expense, to control traffic and parking on the State layout of Route 28. The police officer will control on-site parking and the movement of traffic on and off the premises. 3. The hours of operation at the Flea Market shall be within 7:00 a.m. and 9:00 p.m. each day of operation except that vendors may perform necessary setup work from 6:00 a.m. to 9:00 a.m. 4. No structures of a permanent nature are to be constructed, erected, or caused to be placed on the property used in connection with the Flea Market. All structures, devices, equipment and other gear placed on the property for use in connection with the Flea Market are to be removed at the conclusion of each day's operation. 5. Up to 25 vehicles may be stored or left on the property between the hours of 9:00 p.m. and 6:00 a.m. of the following day in an area located behind Pickwick's Restaurant building as designated on the site plan. At no time are any vehicles, trailers, campers, tents, mobile homes, or other similar devices to be used for human habitation or sleeping during the hours of 9:00 p.m. to 6:00 a.m. 6. All parking shall be on-site. 7. No music is to be played over loudspeakers. S. The petitioner shall conform to and comply with the existing sign code, with prior approval from the Board of Appeals. 9. All displays, sales and flea market operations shall be located at the rear of the current site of the Mini-Golf and festaurant (currently known as Fabio's) . 10. The Applicant shall Constructs stockade fence shielding the dumpster or other trash disposal receptable and the farm tractor or any other equipment used in connection with the maintenance and conduct of the business, so that the same may not be seen from any road or from any abutting property. 11. The Applicant shall maintain the site to remove paper, garbage and other debris from the grounds and shall trim all excessive vegetation, meaning grass shall be mowed and landscaping maintained in a neat and orderly manner, and parking areas and routes of vehicle travel shall be maintained in a neat and hard packed appearance. The site shall be graded so as to maintain a level area pitched to drain away from abutting roads and property and to minimize the pooling of water.
