i BOARD' OF SELECTMEN Page 2 <br /> MINUTES <br /> THURSDAY, DECEMBER 27, 1990 <br /> South Cape Beach A reement: <br /> Kevin Harrington has reported that Town Counsel has reviewed <br /> both drafts and is in support of both draft agreements with approval <br /> from the Board. <br /> Tom Cahir reviewed the process to finalize the agreement over <br /> the next several weeks. He will meet with DEM next week. It is his <br /> understanding that DEM and their counsel have met and will amend <br /> the legislation with this language. In terms of extending the bond, <br /> this will be added on to an appropriation bill which will be forthcoming. <br /> He explains this is a common practice in terms of extending the bond <br /> issue. <br /> DEM' s representative explained that the easiest vehicle to transfer <br /> money from the state to the community for the Great Oak Road improve- <br /> ments is to amend the original legislation. Mr. Vontzalides basically <br /> stated that this would authorize DEM and the Town of Mashpee' s agree- <br /> ment to undertake DEM' s obligation to improve Great Oak Road under a <br /> bond agreement not to exceed the sum of $620,000 to fulfill those <br /> obligations. <br /> Mr. Vontzalides also reports bond appropriation requires a 2/3rd' s <br /> vote and it now a matter of finding the right spending bill in the <br /> process to add on as an amendment to that bill. <br /> In terms of the construction funds, Mr. Vontzalides reports there <br /> is room in the state wide funding cap. Tom Cahir notes the new commissine <br /> is a colleage of his and he has spoken with him about the agreement. <br /> He feels the legal process will occur; in February or March. <br /> Mr. Vontzalides also noted the agreement of access to ten Mashpee <br /> residents for management purposes will be changed to ten registered <br /> vehicles of Mashpee residents. This was also in agreement with Selectman <br /> Gottlieb, Town Counsel, Morris Kirsner and DEM. <br /> The time frame as asked by Selectman Jacobson will occur within <br /> calendar 1991 With the spending bill for appropriation, Tom Cahir <br /> reports it may,,pass in July. The sum of $620,000 would then be transfers <br /> Mr. Kirsner commented on the role and dedication of the Advisory <br /> Committee to all matters particularly during the past several weeks. <br /> In addition to the Advisory Committee, Mr. Kirsner commends Selectman <br /> Gottlieb for his presentation to the Town. DEM was also cooperative <br /> along with- the help from Joe Reardon and Kevin Harrington. Mr. Kirsner <br /> also expressed his appreciation,,:to the Board of Selectmen and is grate- <br /> ful for the climax- of the agreement. <br /> If the agreement as amended be signed by the Board of Selectman, <br /> Commisssioner Kendall should sign the agreement within the next few <br /> days. <br /> Selectman Jacobson thanks Mr. Kirsner for the work the Committee <br /> has done. She agrees it has been a long road with a job well done. <br /> Selectman Gottlieb has also acknowledged the work that the. South <br /> Cape Beach Advisory Committee has done as well as the contributions <br /> from DEM, Tom Cahir and Selectman Hanson. This should be duly noted. <br />
