Page 2 <br /> The Stipulation which was edited and revised by Plaintiff states in <br /> the fifth stipulation that each party will bear its own costs and <br /> also eliminates the wording (which was open but) in the first <br /> stipulation. Ms. King asked that the Finance Committee decide <br /> which version they would agree to so that she could give their <br /> decision to the Board of Selectmen at their next meeting. The cost <br /> of legal fees is approximately $1,500 according to Ms. King. It <br /> was Ms. King's opinion that the Town should go ahead and agree to <br /> pay their own costs. Mr. Watt also suggested that the Town would <br /> have a difficult time recovering legal fees. <br /> Mr. Bacigalupi MOTIONED to accept the Stipulation which contains <br /> Stipulation five (each part shall bear its own costs) . Mr. Golub <br /> seconded the Motion. Mr. Goggin felt that the Finance Committee, <br /> as well as the Town, would be setting a bad precedent by paying <br /> their own legal costs. He felt that if private, citizens wanted to <br /> take Town Officials to Court then they should bear their own costs <br /> and also pay other costs due to it being a frivolous action. Mr. <br /> Golub stated that unfortunately it would cost just as much to <br /> legally get the Plaintiff to pay. Mr. Watt stated that for a suit <br /> to be frivolous then there has to be no grounds for suit and though <br /> this case appears frivolous there was a question. Mr. Bacigalupi <br /> felt that it was time to put this suit behind. The Finance <br /> Committee voted 4-1 in favor of the second Stipulation which states <br /> that each party will pay their own costs. There was a mention <br /> that Chapter 70 money would be a little more than expected <br /> $1,059,730. <br /> There were notices regarding the 1996 MMA Annual Meeting and Trade <br /> Show and also the workshop for the Association of Town Finance <br /> Committees. The first is scheduled for Thursday through Saturday <br /> January 18-20th at the Boston Marriott Hotel/Copley. The second <br /> meeting is scheduled for Saturday, october 28th from 9 :OOAM - <br /> 4:OOPM at the Framingham Sheraton Tara. Ms. King mentioned that <br /> both meetings were very beneficial and that members should consider <br /> whether or not they would be interested in attending. <br /> There was correspondence from the Executive Director of the Mashpee <br /> Housing Authority supplying a new mailing address. <br /> Marilyn Farren sent a memo to all department heads in regard to a <br />
