8 Board of Selectmen Minutes January 23, 2017 Discussion of Tribal correspondence, dated January 10, 2017 and January 13, 2017: The Board of Selectmen reviewed communication received from the Mashpee Wampanoag Tribe respectively on January 10, 2017 and January 13, 2017 in response to the letters received from the Board of Selectmen dated June 16, 2016 and August 18, 2016. In response to the Selectmen's approach to open the lines of communication between Chairman to Chairman, it is the recommendation of the Tribal Council to begin open lines of communication between the full membership of the Tribe's respective bodies. As a way to proceed forward, a meeting of the full Tribal Council and full Board of Selectmen is proposed. Although it was agreed it may be cumbersome to have meetings between all parties, it was decided the Board of Selectmen would accept the invitation while adhering to the mandates of the Open Meeting Law by posting and televising the meeting which is required to be open to the public. It was noted the Tribal Council headquarters has the capability to televise meetings. It was determined the Chairman of the Board of Selectmen would work with the Tribal Council Chairman to develop an agenda for this meeting. The additional communication received from the Tribe dated January 13, 2017 clarifies the Tribe's position with respect to the status of the land in trust. As noted, the Tribe remains situated upon sovereign, reservation land, and the land has remain{ed} in trust. Therefore the MOU remains effective. The Board of Selectmen was also in receipt of communication from the U.S. Department of the Interior, Associate Solicitor—Indian Affairs dated January 13, 2017 regarding the land in trust located in the Town of Mashpee. It was affirmed the lands currently remain in trust. Review and execution of Memorandum of Understanding between the Town and the Mashpee Wampanoag Tribe relative to Mutual Aid Assistance: It was disclosed the Memorandum of Understanding between the Town and the Mashpee Wampanoag Tribe relative to Mutual Aid Assistance was voted upon unanimously by the Tribal Council to approve the extension on January 9, 2017. The executed document was hand delivered by the Tribe to the Town on January 10, 2017. Motion made by Selectman Cahalane to execute the MOU between the Town of Mashpee and the Mashpee Wampanoag Tribe relative to Mutual Aid Assistance for a one-year period terminating on January 11, 2018. Motion seconded by Selectman Sherman. VOTE: Unanimous. 5-0.
