Page <br /> said a plan was originally submitted for approval 10-11 years ago which <br /> is Area B, where the condos are now, and was recorded. He said they <br /> changed Section 0 from condos to single family -and the appeals board <br /> said okay in 1980. Palmer Rd. was approved by the Planning Board, sub- <br /> divided <br /> ub- <br /> divided and recorded. Another part was approved in 197 - 1 land courted <br /> and 1 not, but it was never recorded due to the Indian suit . Mr. <br /> LaOav -would now like to get these plans on record, so he would like <br /> to redraft and combine 2 small plans and hopefully .y it signed as -axe <br /> approval not required as it was in 19 5-. It would still � sub ject <br /> to the covenant and filed with land court. Mr. lrsters stated the <br /> plan wouldn't conform with current zoning. <br /> Mr. Nye said it's still an �2 district as it was thea and was a cluster <br /> development and the certification has to be put on the plan saying the <br /> plan. hasn't been modified, amended or rescinded. He said they're willing <br /> to update the road plans to the present requirements and he wanted an <br /> agreement as to how he should do it . lir. Nye also said they could have <br /> a new covenant with Mr. LaCavals signature and it would be recorded. <br /> Mr. Dubin said they don't want to approve old road profiles if they <br /> agree to build it up to present day standards . Mr. Marsters added the <br /> Board should get the. difference from the old fee and the present fee . <br /> Ir. Dubin said they would have to get a covenant that says they sub- <br /> mitted <br /> ub- <br /> itod updated road profiles before construction begins . Mr. Tarte s <br /> pointed out that the minimum lot size didn't conform to the present <br /> cluster zoiiitg, Mr. Nye suggested they put in the covenant that they <br /> can't obtain building permits prior to increasing the lot size and lir, <br /> Marsters said the covenant should state no lots 'will be released unless <br /> they exceed 15,000 sq . ft . and a revised, updated road plan and profiles <br /> would have to be submitted before any construction in accordance with <br /> current subdivision regulations .
