Chairman Dubin asked the <br /> proponent to agree to an extension of time so that the <br /> Planning Board can act at their next hearing upon review of <br /> the town engineer , Mr. Ferrara said that is all he can do <br /> and that Fre would go to the developers stating that the <br /> Planning Board wants an extension, Charles Rowley agreed to <br /> sand Mr . Ferrara a copy of his report. <br /> Simons Narrow Pd. <br /> Attorney Michael Dunning said that the plan was originally <br /> submitted two meetings ago and that there were questions <br /> raised about the passibility of their being a covenent or <br /> some other assurance with regard to the development of Simons <br /> + Marrow Rd. associated wi h the development of a 47 acre sub- <br /> division. <br /> ub- <br /> divi ion. He said that the main questions were whether or <br /> not road profiles were available and if they could make them <br /> aai fable. <br /> With reference to the drainage, Mr. Ferrara told the Board <br /> that the intersection of MashpeeDeck Road is terrible a <br /> everything is washing down. Earle I ar tern said <br /> that there was no harm in asking. <br /> Attorney Dunning said that Simons Darrow Road was app aaren t 1 <br /> suitable for the development of a 47 acre lot sub-division <br /> signed by the Planning Board some time ago. There was an <br /> understanding between the developer and the Board that the <br /> road would be improved. He said that once the roads are in , <br /> the developer is entitled of the release of the covenant re- <br /> gardless of the condition so that he can sell lots in the <br /> subdivision. It was bought on the assumption that it would <br /> be a su ftabl a public road for the simple sign i-ng of an A&R <br /> plan based on the fact from the records found, at the Regis- <br /> try <br /> egis- <br /> trof Deeds that it had been found suitable b ► the Planning <br /> Board. The Board has said that there was some other agree- <br /> ment with regard to the development of the parcel . He said <br />
