Planning Board Minutes <br /> Meeting of August 15, 1984 <br /> Page <br /> Simons Narrow. cont , <br /> that if that were the case , and in fact that the original <br /> developer did informally agree with the Board to approve the <br /> road, then whatever is out there now was done with the <br /> knowledge of the Board. <br /> Chairman Dubin said that at that time, they started do i,ng it <br /> on a more informal procedure and they could assure that the <br /> Hoard did not police the work as well at that point . The <br /> work was not completed and any agreement that the developer <br /> made does not mean mucor at this point . <br /> Attorney Dunning said that they were willing to meet the <br /> Board half way for the safe of simplicity to accept the plan . <br /> Chairman Dubin said that the further they go they are seeing <br /> that the road is not suitable and does not comply with the <br /> standards. He said that he does not agree with him on the <br /> A&R. He aid' that he d-i d not think -it made any difference <br /> Whether the Town approved the plan on the sub-division. He <br /> said that it has to be something that will sati-sfy the Town <br /> Engineer with respect to the grade and that it would be in <br /> their best interest ,as it will service a lot of lots. At t . <br /> Dunning said that there is a lot of acreage not. owned by the <br /> developer who is being asked to do the wort . Earle Marsters <br /> said that he only being held responsibIe for h-i-s own, Earle <br /> Marsters said that he feels -the Board is meeting them half <br /> way because technical-1y it is a sub-dimision and that the <br /> Board is Buil l ing to go with approval not required providing <br /> they put a covenant , He sa.-i d that the Board is asking them <br /> to construct a road in accordance with sub-division <br /> regulations and that the Board would be willing to waive a <br /> few items such as grade if Town Engineer approves. <br /> Chairman Dubin asked for another extension until the Board"s <br /> next meeting. Attorney Dunning agreed'. The Board said that <br /> the covenant would be dome at the hearing. <br /> Mr . Ferrara expressed concern about the water coshing from <br /> a hpee Neck Road. Earle said that perhaps the Highway <br /> Surveyor could pert basins i n. <br /> Sea Oaks Condominiums <br /> Attorney Richard Morse was present to represent the Sea Oaks <br /> Condominiums, He said that the plan did not show the whole <br /> access road to the condominium.
