i
Motion made, seconded and unanimously carried to require an engineer's plan for all
salt water dodos, per chapter 91.
. FAA-AFCEE. Bob reported that AFCEE has requested an administrative approval
for the replacement of the FS-1 treatment plant. They have to made it bigger but Bob
said it doesn't have any negative consequences, and he recommended approval.
Motion made, seconded and unanimously carried to approve this administrative
request.
. Letter from Division of Marine Fisheries. Bob said the letter opines on the Leslie
dock, and while it's nice to have their input, we received it after we gave our approval.
He doesn't think they are required by lair noir to render an opinion to us before vire
issue an Order of conditions. However, since they are evidently going to be reviewing
dock applications, if there is any doubt in our rind that there are shellfish issues,
perhaps our policy should be that vire have the option to wait for D F's opinion before
we close and issue. We now get input from the shellfish Warden, and Bob has high
regard for the people at DMF. Bob v ill call thea and ask how quickly they could give
us their opinion upon receiving any plans affecting shellfish.
. Article for TI I-Chapter 172 - extensions. Bob distributed to the members an
amendment in our by-laws which he and Elliot have prepared pertaining to extensions.
. RFAA - SE 3-215 . Bob recommended approval.
Motion 'made, seconded and unanimously carried to approve the changes for the
administrative review for S 43-2159.
. Kopelman & Paige's advice on Procedures for convening Executive sessions and
Rights of Individuals. Bob said this is in the members' mailboxes.
i
10. Donation of benches. Bob said two donations of benches have been made -- one
from Elliot and another from a woman in memory of her loved one.
11. Halpern violation. Bob said this was to go to court, thea he got a call from Town
Counsel saying the parties should meet instead of going to court and cost the Town
money. We agreed, but nobody showed up. Bob said 1 he could send a letter saying
we have a plan to be approved by the end of February or we are going to court and we
will not change our mind, or 2 vire can go to court now. Stephanie said this case has
been delayed for months, and it was agreed that we would go to court noir.
Motion made, seconded and unanimously carried to go to court now, and Bob will refer
any more phone calls from the defendant's attorney to Town Counsel.
i
