Wachtenheim - Request a Special Permit <br /> under Section 174-17 of the Zoning By-laws for permission to <br /> expand a non-conforming structure with the replacement of a <br /> house and garage in an R-3 zoning district on property located <br /> at 78 Popponesset Island Road ( Map 106, Block 30 ) Mashpee, MA . <br /> Stanle and Mindy S . Wachtenheim - Request a Variance ,from <br /> Section 174-31 of the Zoning By- laws for permission to vary <br /> the front set--back requirements in an R--3 zoning district on <br /> property located at 78 Popponesset Island Road ( Map 106, Block <br /> 30 ) Mashpee, MA. <br /> Members sitting : W. Hanrahan, M . Makunas, C. Hawver <br /> Attorney Kevin Kirrane represented the applicant and presented <br /> plans for the removal of an existing seasonal cottage and <br /> garage and the replacement with a new year-round home . He <br /> explained that he had met with the Conservation Agent and the <br /> house placement was designed to preserve the distance from the <br /> coastal bank . This has resulted in the necessity to move the <br /> structure closer to the street resulting in a 20 ' setback at <br /> one corner. The garage, the lot coverage and side- line <br /> setbacks comply with existing zoning . Mr . Kirrane stated that <br /> the upgrade of the property is consistent with the upgrade of <br /> other properties in the area and would be in harmony with the <br /> neighborhood . He stated that impact of the coastal bank on the <br /> lot creates a hardship in placement of any structures on the <br /> lot . No comments were received from abutters . <br /> Mr. Hanrahan moved to grant the Variance in front set-back <br /> stating that the hardship was the proximity to the coastal <br /> bank . Mr. Makunas seconded . All agreed . <br /> Mr. Hanrahan moved to grant the Special Permit , Ms . Hawver <br /> seconded . All agreed . <br /> Bonwood : Ron Bonvie explained that a site visit to Soutport <br /> on October 11 , 1991 had resulted in the memo from Elias <br /> McQuaid . Mr. Bonvie had not been notified of this visit . He <br /> said he has received several lists of work to be done , He has <br /> completed the requirements of the Fire Department and has <br /> corrected most of the .items on the Board of Health and <br /> Building Department lists . <br /> Elias McQuaid reviewed the list of violations and discussed <br /> which had been completed . He stated that a tremendous amount <br /> of time is being spent by him on Soutport . He said it was <br /> costing the Town money to keep an eye on this project . <br /> Ron Bonvie said he has received several lists of items to be <br /> corrected and these new items were not included . Mr . Boyd <br /> said this was the third time violations had been listed . Mr. <br /> Bonvie stated that there had been inconsistencies in the <br /> corrective procedures he was permitted . <br />
