The Chair pointed out[flat the <br /> housing authority had offered a Memorandum of Understanding (MOU) to the town a while ago <br /> to allow a town staff member to review files in confidence=abiding by 760 CMR(Code of <br /> Massachusetts Regulations) 8.04. The Chair stated that the housing authority is the holder of <br /> confidential information and must abide by the regulations and laws related to that. 760 CMR <br /> 9.04 states that with regards to dissemination of personal data,"A Holder shall not allow any <br /> individual, agency, or entity not employed by time Holder or under contract or agreement with the <br /> Holder under 760 CMR 8,04(f) to have access to personal data unless such access is(a) <br /> authorized by statute or byregulations which are consistent with the purposes of M.G.L. c. GGA;. <br /> or(b) approved by the data subject, unless the data subject is "not entitled to access." MGL <br /> Chapter 66A defines"Personal data"as any information.concerning an individual which, because <br /> of nanme� identifying number, mark or description cats tae readily associated with a particular <br /> individual." <br /> Time Chair stated that the Board of'Selectmbn are looking for the following information: Who the <br /> cheeks are.written to, their address,.the amount of the check, what the payment is for (Le. rental <br /> assistance, mortgage assistance, etc.), and time property address.for which the.assistance is being <br /> paid.. We care divulge all of the information, and have already, except the address feu the <br /> recipient of:the assistance as this is a personal identifier of'someone receiving public assistance, <br /> He stated that if we had all .M:O,U., we'd have a contract/agrcement with someone.in the town <br /> and could then divulge the information in confidence as outlined in 760 CMR 8.04(2). The <br /> Chair informed the board that Attorney Grace(Regional Attorney for the State Department of <br /> Housing & Community Development) has advised us not to"riot give the program participant's <br /> name and.address because it(sie) identifies that individual as a recipient of public assistance. 1 <br /> think it can be,argued that it is an invasion of personal privacy. <br /> The Chair then stated that in July 2014 the MHA Beard of Commissioners voted to approve an <br /> audit and .0 latter was sent to'fown Manager Joyce.Mason which stated"The Maslipee housing <br /> AcithOrity Board of'Conmiissioners recently nietregarding your continued request to audit our <br /> records for the -lousing Assistance Program, <br /> Pal=e. 3 of 6 <br />
