Landlord will keep the exterior and the common areas of the Leased Premises in repair, <br /> provided that Tenant shall give Landlord written notice of the necessity of such repairs, and <br /> provided that the damage thereto shall not have been caused by the gross negligence of Tenant, <br /> its agents, employees or servants, in which event Tenant shall be responsible therefor. Landlord <br /> shall ensure sufficient electrical, water supply, and sewer services are available to the unit for the <br /> Tenants use. The Landlord shall maintain all heating, ventilation, and air conditioning <br /> units/service in working order and perform regular maintenance,to be performed at least <br /> biannually, of those systems at least annually for the duration of the Lease Term. If any of the <br /> aforementioned items require repair, Landlord agrees to address the issue in a prompt and timely <br /> manner to ensure that Tenant may continue to utilize and enjoy the Premises. Tenant willkeep <br /> the interior of the Leased Premises in good repair and will surrender the Leased Premises at the <br /> expiration of the term of the Lease in good, vacuum-clean condition;excepting depreciation <br /> caused by ordinary wear and damage by fire or Act of God. Tenant will not overload the <br /> electrical wiring serving the Leased Premises or within the Leased Premises. <br /> The Tenant, shall make all the necessary repairs and replacements,pertaining to the Leased <br /> Premises including the repair and replacement of pipes, electrical wiring,heating and plumbing <br /> systems, fixtures and all other systems and appliances and their appurtenances. The quality and <br /> class of all repairs and replacements shall be equal to the original worth. If Tenant defaults in <br /> making such necessary repairs or replacements, the Landlord may make them for the Tenant, and <br /> such expenses will be considered additional rent to be payable by the Tenant upon Landlord's <br /> demand. The Tenant shall not permit the Leased Premises to be overloaded, damaged, stripped, <br /> or defaced, nor suffer any waste. It is agreed that Landlord will allow Tenant to perform <br /> mutually agreed upon interior improvements. Landlord represents and warrants that the Leased <br /> Premises are in good condition and repair, and that as of the date of this Lease the condition of <br /> the Premises complies with all apphcable codes laws and regulations of Py governmental <br /> authodty, exce t for fire sLipprqssion s stems. Tenant shall be responsible, at its sole expense, for <br /> the installation of all fire-Euppression systems re aired by the Massachusetts Cannabis Control <br /> Commission's regulations, 935 CMR 500.00 et seq., with the understanding that said installation <br /> shall be for the leased premises only and no other portion of the Landlord's propg . Landlord <br /> will immediately perform all necessary repairs to bring the Leased Premises into compliance <br /> with these warranties and re resentations for an condition discovered by Tenant within 120 <br /> days of ogggpancy, except with regard to latent or structural defects which shall be.Landlord's <br /> responsibility to repair at any time. LANDLORD SHALL UPDATE AND REPAIR FRONT <br /> STEP, SIDEWALK AND HANDICAP RAMP TO CODE. SAID WORK TO TAKE PLACE IN <br /> FRONT OF RENTED SPACE AND INTO MAIN ENTRANCE. LANDLORD SHALL <br /> MAINTAIN THE EXTERIOR OF THE BUILDING,THE HVAC SYSTEM,THE ROOF AND <br /> SEPTIC SYSTEM. <br /> 9. ALTERATIONS BY TENANT: <br /> Tenant will not make any alterations to the Leased Premises, or any part thereof, without <br /> first obtaining Landlord's written approval of such alterations; which consent shall not be <br /> unreasonably withheld, conditioned or delayed, and Tenant agrees that any improvements made <br /> by it shall immediately become the property of the Landlord and shall remain upon the Leased <br /> Premises in the absence of an agreement to the contrary.
