with the deductible for each policy being no higher than$5,000 per occurrence. 12. NO LIABILITY-INSURANCE: No Liability- A. The Tenant agrees to take such steps as it may deem necessary and adequate for the protection of itself, and its agents, employees, invitees, and the property of the foregoing, against injury, damage or loss,by insurance, as a self-insured, or otherwise. The Landlord, its agents and employees shall not be liable for any damage to property of the Tenant in the Leased Premises unless due to negligence of the Landlord and its agents. B. The Tenant shall not be entitled to claim a constructive eviction from the Leased Premises unless Tenant shall have first notified Landlord in writing of the condition or conditions giving rise thereto,unless Landlord shall have failed within a reasonable time after receipt of said notice to remedy such conditions. Insurance- C. By Landlord. Landlord shall at all times during the term of this Lease, at its expense, insure and keep in effect on the building in which the Leased Premises is located a policy of hazard insurance including fire insurance coverage. The Tenant shall not permit any use of the Leased Premises which will make voidable of any insurance on the property of which the Leased Premises are a part, or ori the contents of said property or which shall be contrary to any law or regulation from time to time established by the applicable fire insurance rating association. Tenant shall on demand reimburse the Landlord, and all other tenants, all extra insurance premiums caused by the Tenant's use of the premises. D. By Tenant. Tenant shall, at its expense, during the terra hereof, maintain and deliver to Landlord all liability insurance policies with respect to the Leased Premises. Such policies shall name the Landlord and Tenant as insureds, and have limits of at least $1,000,000 for injury or death to any one person and$250,000 with respect to damage to property Such policies shall be in whatever form with such insurance companies with an AM Best rating of A or better as are reasonably satisfactory to Landlord, shall name the Landlord as additional insured, and shall provide at least thirty(30) days'prior notice to Landlord of cancellation. 13. INDENINIFICATION: The Tenant will indemnify the Landlord and hold it harmless from and against any and all claims, actions, damages liability and expense, including reasonable attorney's fees, in connection with lost of life,personal injury and/or damage to property occasioned wholly or in part by any negligent act or omission of Tenant, its agents, contractors, invitees, or employees. 14.
