with the deductible for each policy being no higher than$5,000 per occurrence. <br /> 12. NO LIABILITY-INSURANCE: <br /> No Liability- <br /> A. The Tenant agrees to take such steps as it may deem necessary and adequate for <br /> the protection of itself, and its agents, employees, invitees, and the property of the foregoing, <br /> against injury, damage or loss,by insurance, as a self-insured, or otherwise. The Landlord, its <br /> agents and employees shall not be liable for any damage to property of the Tenant in the Leased <br /> Premises unless due to negligence of the Landlord and its agents. <br /> B. The Tenant shall not be entitled to claim a constructive eviction from the Leased <br /> Premises unless Tenant shall have first notified Landlord in writing of the condition or conditions <br /> giving rise thereto,unless Landlord shall have failed within a reasonable time after receipt of <br /> said notice to remedy such conditions. <br /> Insurance- <br /> C. By Landlord. Landlord shall at all times during the term of this Lease, at its <br /> expense, insure and keep in effect on the building in which the Leased Premises is located a <br /> policy of hazard insurance including fire insurance coverage. The Tenant shall not permit any <br /> use of the Leased Premises which will make voidable of any insurance on the property of which <br /> the Leased Premises are a part, or ori the contents of said property or which shall be contrary to <br /> any law or regulation from time to time established by the applicable fire insurance rating <br /> association. Tenant shall on demand reimburse the Landlord, and all other tenants, all extra <br /> insurance premiums caused by the Tenant's use of the premises. <br /> D. By Tenant. Tenant shall, at its expense, during the terra hereof, maintain and <br /> deliver to Landlord all liability insurance policies with respect to the Leased Premises. Such <br /> policies shall name the Landlord and Tenant as insureds, and have limits of at least $1,000,000 <br /> for injury or death to any one person and$250,000 with respect to damage to property Such <br /> policies shall be in whatever form with such insurance companies with an AM Best rating of A or <br /> better as are reasonably satisfactory to Landlord, shall name the Landlord as additional insured, <br /> and shall provide at least thirty(30) days'prior notice to Landlord of cancellation. <br /> 13. INDENINIFICATION: <br /> The Tenant will indemnify the Landlord and hold it harmless from and against any and all <br /> claims, actions, damages liability and expense, including reasonable attorney's fees, in <br /> connection with lost of life,personal injury and/or damage to property occasioned wholly or in <br /> part by any negligent act or omission of Tenant, its agents, contractors, invitees, or employees. <br /> 14.
