Box 1 108 MASHPEE, MA 02649 PLANNING BOARD MINUTES : 2/20/85 P• 5 Petitioner: Mr. Winslow Submitted by: John Doyle Type of Plan: Preliminary Fee : $50 Mr. Doyle maintained he validly submitted the plan when he submitted it to the Town Clerk on February 8 . He said he paid for it at the time and it was stamped by the Town Clerk. Tom Fudala said the Board of Health denied it . Mr. Doyle said hb would like it to go on record that the issue was raised about the Board of Health by the Town Planner that they had received the plan. Ms . Stone said the Town Planner is not a member of the Board. Mr. Marsters moved to notify the owner that the plan was not submitted properly prior to the town meeting and therefore doesn't conform with current zoning requirements . Mr. Jonas seconded and all voted in favor. Mr. Dubin said he 's going to write a letter to Town Counsel and put them on the agenda for March 6. Mr. Govoni came before 'the Board requesting a zoning change for his business on Rte . 151 & Brickyard Rd. He said commercial was voted in 1972 to Brickyard Rd . , eliminating his site , but the building was operating then as commercial. The Board informed him they couldn't initiate it as it has to be the owner. They told him to hire an attorney to draft an article , get a plot plan and map. He wouldn't need the signatures as he 's the owner® Then the Board will have to hold a public hearing and make a recommendation on town meeting floor. They felt he would have time to submit it for the special town meeting held prior the the annual. Petitioner: Philip Boudreau Submitted by: Frank Whiting Type of Plan: Approval Not Required Location: Fee : Mr. Whiting submitted the plan to the Town Clerk on February 4. The Board informed him that it wasn't a proper submission, this was the first time the Board saw it . Mr. Rowley pointed out it would have to be signed simultaneously by Sandwich .
