Dubin , Richardson Jonas, Anthony ! <br /> Ferragamo, Michele Stone <br /> TOWN PLANNER: Tom Fudala <br /> TIME : 8:00 p .m. <br /> Dick Dubin started the meeting off with the first item on <br /> the agenda. The public hearing of Bay View Builders. <br /> The next item on the agenda was the proposed change in <br /> zoning located on Route 130/Cotuit Road and on assessors map <br /> 37 lot C3. They want to redesignate a portion of the R-311 <br /> Residential District to a C-2 Commercial District . Richard <br /> Shanasee who was representing Timberlane Shores Ass. , said <br /> for the record, that this pe | ce of land was changed from <br /> commercial to residential last Town Meeting. Dick Dubin <br /> asked if there were any comments on this matter . Richard <br /> Shanasee said the reason for the change is that all the <br /> surrounding area is residential except for the glass works. <br /> He hopes that the town will take the land over . Timberlane <br /> � -� Shores Ass . thinks it should remain residential . Priscilla <br /> ^ � <br /> � Ham wanted to say that the correct procedure was followed to <br /> notify Mr . Burnes. Dick Dubin said that the obvious thing <br /> for the record is that it sounds like it would be spot <br /> zoning. He then asked if there were any other comments, <br /> being none the hearing was closed. <br /> Next item the board went over was the Ancient Way Article . <br /> Dick Dubin summarized the contents of the article . The <br /> article was submitted by the Historical Commission . Marie <br /> Scally of the Historical Commission had a couple of <br /> amendments to be made . In section 4. 1O line 5 insert the <br /> word "means" after "subsection" . In section 4. 10 .3 line 2 <br /> insert the word "private" after the word "any" . In section <br /> 4. 10 .5 lino 2 insert "or other relavant authority" after <br /> "Section 21 " , same thing for section 4 . 10 .6. Tom Fudala <br /> said that there are changes in Section 4. 10 .7 and 4. 10 .8 but <br /> these changes will be made at Town Meeting Floor . <br /> Dick Dubin asked if there were any questions and Fred Peters <br /> asked if there were any existing laws covering ancient ways . <br /> Mr . Dubin said there is a general law that deals with <br /> ancient ways, Chapter 82 Section 20 and that law provides <br /> that a Town can not discontinue or abandon the road without <br /> ' the Selectmen acting and then the Town approving / t . The <br /> main issue of the article is the Selectmen and Towns <br /> \ involved in the abandoment of woods roads as opposed to some <br /> �� <br />
