Peters then wanted to know that if an <br /> � ancient way is on a map how do you take that off the map? <br /> Mr . Dubin said that some of the ways have been brought up to <br /> standard and some have been realined to make it safer . In / <br /> all the years that Dick Dubin has been nn the Planning Board <br /> they have respected the state law that says you can' t <br /> interfere with the public 's prescriptive right to use a way . <br /> The main problem that Dick Dubin has is the definition of a <br /> way. Every single subdivision that has a wood road is to be <br /> brought in front of the Selectmen for permission . Tom <br /> Fudala said that it wouldn' t happen if every wood road or <br /> public way wasn' t re-arranged or blocked off or obliterated <br /> by a subdivision . Someone from the floor recommended <br /> listing all the ways that this would protect . Tom Fudala <br /> mentioned that 7-own Counsel did have a map but said to take <br /> it out of the article . Doug Stores went on to say that there <br /> is an interest to protect an ancient way . There is no way <br /> to determine what is a public way and what isn' t without a <br /> map , especially with the term perscr | ptive use . Mario <br /> Scully said that the biggest problem is that all the <br /> historical records are up in Boston . <br /> Dick Dubin asked if there were any comments. Mr . Hnlemyer <br /> said that if you have any ancient ways you better protect <br /> them. Richardson Jonas said that he did not like Town <br /> Counsel ' s wording. John Umina then asked if he gets <br /> � <br /> permission from the Planning Board and Selectmen why would <br /> � he have to go to Town Meeting? Tom Fudala said that you <br /> would because your planning to modify the road. <br /> Tom Fudala was then asked by Dick Dubin if he would read <br /> over the amended version of section 4. 10 .8. The floor <br /> thought this version was better . Mr . Blakeman then asked <br /> about a footpath that would go along a stream, river or <br /> lake . Dick Dubin siad that this would apply to footpaths <br /> that are not ancient ways. <br /> Dick Dubin moved on to the next article and asked if Tom <br /> Fudala would give the background on the article . When he <br /> was finished John Umina asked how much of the wetlands would <br /> we be able to use? Tom Fudala said there is no limit . <br /> Earle Martsters said there should be a limit on marshland. <br /> Dick Dubin asked / f there were any question , being none he <br /> closed the article . <br /> Dick Dubin moved on to read the next article . He mentioned <br /> that he had a couple of ideas. It' s a good idea but he <br /> thinks that it should be amended to 1/2 the lot size or 50 <br /> feet back from the water , 100 feet is to strong. <br /> Dick Dubin went on to the next article . He asked if Tom <br /> Fudala would briefly go over this article . Tom Fudala <br /> � <br /> � mentioned that there will be one change on the Town Meeting <br />
