Marsters/Bayshore Inc. <br /> Falmouth-Sandwich Road on north side of Ashumet Pond <br /> Definitive Plan approval of 3 lot subdivision <br /> Mr. Rowley stated head wall needed near ditch shown on plan, adequate <br /> ppotection necessary. Mr. Fudala pointed out small burial ground <br /> identified on property. Historical Commission member stated it <br /> was the Hicks family plot. opposition to development of 3 lot sub- <br /> division voiced because of the location of the Indian burial site, <br /> and it was recommended work be stopped until this plan is studied <br /> further. Charles Alexander stated that, as a small child with snow <br /> on the ground, he could see 20 plus or 30 graves. He informed Board <br /> burial ground starts approximately 5 to 6 feet from their former <br /> property line and goes 75-100 feet from sandwich Road. Representative <br /> of Mr. Marsters stated he had talked with Mr. Alexander who had <br /> brought the existence of the burial site to his attention. <br /> Chairman introduced subject of potential water quality problems, <br /> aircraft noise and related aircraft safety problems, as well as <br /> Health Department 's moratorium on new wells. Town resident Alexa <br /> M. Fox queried applicant regarding ultimate number of lots to be <br /> developed in proposed subdivision. Chairman stated applicant merely <br /> protecting zoning, that present plan reflected only 3 lots . Public <br /> hearing continued to December 4, 1985 . <br /> Public Hearing: Desoto Trust/Paul O'Connell III <br /> North of Red Brook Road between Great Hay Road and <br /> Great Neck Road <br /> Definitive Plan approval of 5 lot subdivision <br /> Mr. Gerald Garnick suggested plan be allowed subject to any opposition <br /> taking place. After discussion, Mr. Jonas stated all known abutters <br /> and co-owners should be notified. Mr. Garnick presented a copy of <br /> deed of record to show what applicant owns. chairman pointed out that, <br /> whether application was approved or not, future buyers ' legal repre- <br /> sentatives would have to do title search, and the Board 's approval of <br /> plan would not be conclusive as to whether or not the title is good. <br /> Chairman stated the Board should require notice be sent out to co- <br /> owners of property, and if there are deceased parties and nobody knows <br /> the heirs, publication is adequate . Mr. Collins moved to accept under <br /> those conditions, seconded by Mr. Jonas, and Board voted unanimously <br /> in f avor with Mr. Ferragamo, abstaining. <br />
