PLANNING BOARD MINUTES NOVEMBER 6, 1985 PAGE 4 <br /> Public Hearing: South Mashpee Highlands Trust <br /> Between Mashpee Neck and Simons Narrows Road <br /> Definitive Plan approval of 94 lot Down=-East Estates <br /> Subdivision <br /> Chairman presented memo from Board of Assessors to the effect the <br /> Town of Mashpee owns 2 parcels of land within the boundaries of pro- <br /> posed subdivision. Richardson Jonas claims title to 2 parcels. <br /> Chairman stated Town could lose rights if Board were to approved <br /> plan. Chairman suggested notation be put on Assessor 's map showing <br /> Town's ownership. Mr. Schilling proposed language as follows: "The <br /> approval of the Planning Board does not affect any rights the Town <br /> might have to claim of ownership of any land within the subdivision. " <br /> The chairman added "making reference to the Assessor's map and parcels. " <br /> Mr. Collins moved to approve subdivision plan including language given <br /> by Mr. Schilling, seconded by Mr. Ferragamo. Board voted approval <br /> unanimously, with Mr. Jonas abstaining. <br /> Special Permit: Mary Lopez <br /> Meetinghouse Road <br /> Discussion of Planning Board action on <br /> "Meetinghouse Village" condominium project <br /> Chairman stated that because of suit pending, Planning Board is en- <br /> titled to negotiate in an effort to resolve the suit with applicant. <br /> Robert Mills, representing applicant, stated concerns of persons <br /> living in Meetinghouse village arise out of interpretation of <br /> Chapter 40A. Chairman stipulated notice did not go out. <br /> Release of covenant: Quashnet Valley Trust by Tom Devane <br /> Mr. Collins made motion to release lots, seconded by Mr. Jonas. <br /> Board voted unanimously in favor. <br /> Definitive Plan: Quinaquisset Realty Trust <br /> Quinaquissant. Ave./Mashpee Neck Road/ <br /> Bryants Cove Road <br /> Plan signed. <br /> Definitive Plan: Elise M. Otis et al. <br /> west side of Central and Lowell Roads, <br /> north of Ashers Path and east of Lovell 's Lane <br /> Plan signed. <br />
