C` mutt of ceagljpce
~ ' P. O. BOX 1106
P F'La MASHPEE. MA 02649
PLANNING BOARD MINUTES OCTOBER 2, 1985 PAGE 5
Approval-Not-Required Plan: Leslie Hughes
Route 130 east of Cotuit Road
Discussion of 2-lot A.N.R. plan
Mr. Dubin again asked if anyone was present representing Leslie Hughes. There
was no response.
Approval-Not-Required Plan: Leo Gregoire
Old Mill Road
Discussion of A.N.R. plan
Mr. Dubin again asked if anyone was present representing Leo Gregoire. There
was no response.
Mr. Dubin stated that it had been decided to continue Elise M. Otis et al until
October 16.
Mr. Nye stated that "Water's Edge" was supposed to be on the agenda for tonight.
It will be put on the agenda for October 16.
Definitive Plan: Earle M. Maxsters/Bayshore, Inc.
Falmouth-Sandwich Road, north side of Ashumet Pond
Discussion of Definitive Plan for 25-lot cluster subdivision
Mr. Michael A. Dunning representing Bayshore, Inc. Discussion on preliminary
review of 25-lot cluster plan being proposed. It will be presented to the Board
of Appeals and then it will come back to the Planning Board. A 3-lot definitive
plan has also been filed for this site. Mr. Dunning gave Mr. Dubin letters of
extension on both plans (60-day extension in the case of the 3-lot definitive plan
and 6-month extension in the case of the 25-lot cluster plan) . The zoning is R-2.
A special permit was granted for this site by the Board of Appeals about 10 years
ago. That called for an extensive 61-unit condominium project together with 10
single-family lots. Tonight they presented a modification of that original plan.
Their first step will be to go to the Board of Appeals for the special permit.
Mr. Dunning stated that all they wanted tonight was preliminary comments. There
was a discussion on usable open space. Mr.. Dubin would like to see more;
preferably one of the interior lots (Lots #15, 16, 17) should be taken out. Mr.
Fudala brought up that with this number of units, under Mr. Reaxdonls reading of
the protecting provider, this would not be protected. Mr.. Dunning stated that
the definitive plan was filed within 7 months of the preliminary., so the 25-lot
subdivision is a descendant of the preliminary that was entitled to protection.
The issue will be addressed. They will submit a waiver_ regarding the dead-end
road. The Board voted informally to approve the plan with the deletion of one
lot (between 'rY14-'17) . All in f avor.
