The <br /> land is actually - not only is it in two different . ownerships but it <br /> is also held in two different types of ownership - there is a green <br /> ' line runs up like this to here - the land in here is land that deeds <br /> are recorded in the Registry of Deeds. To the south of that is all <br /> land that is recorded with the Land Court so the submission actually <br /> consists of a linen plan that subdivides all registered land and then <br /> there is a mylar plan that subdivides the unregistered land . As far <br /> as the plan, itself, the minimum lot size in this particular _ is <br /> 40 , 000 square feet . All other lots in this exceed that particular <br /> requirement . The minimum frontage - some have - <br /> Mr . Jonas : Where is the driveway to get in and out? <br /> Mr . McGrath : The driveway that comes in here now runs across this <br /> particular border, comes across in here - that ' s shown on the plan. <br /> There is a note on the plan that all of the different lots such as <br /> 18 and 18A - 17 and 17A - all must be merged - that ' s explained in <br /> various notes on the plan. While it is true that we did file a <br /> preliminary plan for this portion and the roadway then came out to a <br /> point here - almost simultaneously but separated by a couple of months <br /> we filed a plan that showed a cul-de-sac coming up here - I believe <br /> it is in the public interest that these subdivisions be merged . I <br /> don' t believe it is in the public interest to have two roads only <br /> a couple hundred feet apart because Great Neck Road can be a high <br /> speed road . It is in the public interest that these two parties get <br /> together and construct one road. Mr . Haney, who is the Trustee of <br /> Ockway Bay Realty Trust , if he had wanted to get the maximum number of <br /> lots , he could position the roadway over here and come down parallel <br /> and we can get 12 conforming lots just from his parcel . We can get <br /> at least three or four on one - so with this particular design we are <br /> creating less lots than we could probably fit if we design for the <br /> maximum number . With this in mind, we would like to submit a request <br /> for a waiver on the road construction. The particular wai.veris for <br /> the Board to waive the minimun road width of 20 ' to 16 ' and probably <br /> the easiest thing for me is to read this letter aloud to the Board . <br /> (Letter attached hereto . ) <br /> When we filed these plans , we also submitted these to the Mashpee <br /> Board of Health on the date they were mailed - May 28th. They have <br /> 45 days to comment and 45 days have elapsed . I called asking if they <br /> were going to comment and the Board of Health secretary told me they <br /> were not planning to- that they saw no problems . I did submit to the <br /> Board of Health a plan showing all the wells and septic systems for <br /> the lots . Previously the Board discussed whether or not to go ahead <br /> with the public hearing and I asked the Board ' s permission to meet with <br />
