Mr. Phelan inquired whether work on Phase IV would begin after completion of Phase III and Mr. <br /> Falacci responded that work on Phase IV would not begin right away. There was consensus from the <br /> Board to have Mr. Rowley work with the project proponent on erosion control. <br /> Mr. Rowley inquired about a reduction of units from 81 lots to 78 and Mr. Crispin confirmed that 3 <br /> lots would not be part of the plan as the lot lines traveled through an existing building. An ANR would <br /> be submitted to create the 3 lots at a later time,which Mr. Rowley confirmed could be done. There <br /> were no additional comments. The Chair shared Health Agent Glen Harrington's memo confirming <br /> that the Board of Health approved the Phase IV New Seabury, Cottages plan on February 20. The <br /> public was invited to address the Board. <br /> Mike McManus, representing Vacation Resorts International and Cape Cod Holiday Estates, inquired <br /> further about the access at Red Brook Road, and Mr. Falacci confirmed that the cut in area was from <br /> Eversource removing trees. Mr. McManus expressed concern about existing water runoff and flooding <br /> at 4 Seasons Drive. Mr. Falacci confirmed their plan to reduce the amount of water currently flowing <br /> and capturing it on site with retention basins,rain gardens, gutters and dry wells, landscaping and <br /> grass, as well as the road capturing some of the runoff. Mr. McManus expressed concern about some <br /> neighbors that would have a view of the new development and Mr. Falacci showed the areas where <br /> trees would be removed and where they would remain untouched. Mr. Rowley stated that more detail <br /> was needed to finalize the plan to address potential runoff issues, because stripping of the slope would <br /> create new issues. The Chair explained to Mr. McManus that Mr. Rowley would be working on the <br /> matter and Mr. Rowley added that New Seabury would also need to remain compliant with the EPA's <br /> NPDES Permit, with a plan on file. Mr. McManus expressed concern that the site did not need to <br /> comply with setbacks and the Chair responded that it was due to the permitting of the time. Mr. <br /> Falacci stated that the footprint had been similar in each.of the phases and 80 people had already <br /> purchased, so the setting of the houses were well-received. Mr. McManus inquired about the walking <br /> trail and Mr. Falacci showed that where the trail traveled through a property (lot 10), it would be <br /> relocated to the property line. The path could continue to be used. <br /> There was no additional public comment or Board member questions. <br /> Mr. Rowley suggested that,while conditioning the erosion control, a final copy of the plan should be <br /> presented to the Planning Board for approval. Mr. Rowley suggested that trees could be removed for <br /> the cutting of the roads, and installing the berm prior to cutting trees for the lots. <br /> MOTION: Mr. Balzarini made a motion to close the Public Hearing. Mr. Phelan seconded the <br /> motion. All voted unanimously. <br /> MOTION: Mr. Balzarini motioned approval of the 81-lot Definitive Subdivision Plan of Land <br /> consisting of 16.29 acres located on Rock Landing Road and Red Brick Road,New Seabury <br /> "Section 5",with the following condition that the Phased construction plan and detailed erosion <br /> control plan is submitted to the Planning Board for review and approval prior to any clear <br /> cutting of any lots proposed in the western portion of Cobblestone Lane, not to apply to the <br /> cutting of the trees in areas of the proposed road layout. Mr. Phelan seconded the motion. All <br /> voted unanimously. <br /> OLD BUSINESS <br /> 5 <br />
