LICENSES AND PERMITS <br /> The Tenant represents that it shall use its best efforts to obtain, at its sole cost and <br /> expense, all necessary licenses, per .its, variances and such other approvals as may be <br /> required by municipal, state and federal governments for the operation of a General <br /> Store, including but not limited to a seasonal retail alcohol license, on the premises <br /> (collectively, the "Permits"). If Tenant has not obtained.a seasonal retail alcohol license <br /> b July 1, 2020,o, the provisions of Paragraph 36 herein shall apply. Tenant agrees to <br /> maintain the Permits throughout the term of this Lease. <br /> In the event Tenant obtains a seasonal retail alcohol license, Tenant agrees as follows: <br /> not to transfer or encumber the liquor license for the premises Without <br /> Landlord's prior written consent; <br /> (B) to keep all accounts With all liquor distributors current. <br /> At the Landlord's request, Tenant shall provide Landlord with copies of liquor invoices <br /> and copies of checks and/or paid ire ceiplts detailing payments made ,to liquor distributors <br /> in the pricer month. Tenant authorizes Landlord to obtain information :from any liquor <br /> distributor concerning Tenant's account. Upon execution of this Lease, Tenant shall <br /> execute a letter in the form attached hereto as Exhibit D authorizing Landlord to obtain <br /> such.information. <br /> Tenant shall pay an additional deposit to Landlord in the amount of 1, 00.00. In the <br /> event that Tenant fails to pay an.y liquor distributor amounts owed such distributor within <br /> a period of thirty days after deliverer of such liquor products, Landlord may pay any <br /> amounts due from such deposit funds. If Tenant has paid all liquor bills as of December <br /> 31, 2020, Landlord shall rem to Tenant any rera.ain*ng funds from this $1,500.00 <br /> deposit. Tenant shall indemnify,and hold Landlord harmless for any cost or expense, <br /> including reasonable attorneys fees, incurred by Landlord as a result of Tenant's failure <br /> to pia.y for liquor purchases. <br /> Upon termination of this. Agreement for any reason or upon default of Tenant under an <br /> of its obligations hereunder, Tenant agrees to cause to be transferred to Landlord or its, <br /> designee the liquor license issued for the Premises. Tenant agrees to cooperate in such <br /> transfer and agrees to execute or cause to be executed any and ,all instruments necessary <br /> to effectuate the transfer of said liquor license. In addition, by execution of the <br /> Agreement, Tenant irrevocably appoints Landlord as Tenant's attorney-in-fact to execute, <br /> acknowledge and deliver any and all instruments necessary to effectuate the transfer of <br /> said liquor license. <br /> 6, LI ITO LIA ILtIT' <br />
