Tenant shall not violate or permit any violation of any conditions, regulation or law in <br /> connection With any liquor license or the sale or provision of alcoholic beverages in <br /> general. Tenant shall indemnify and hold Landlord harmless from any liability, order, <br /> judgment, fine or other penalty imposed upon Landlord, as a result of conduct of Tenant, <br /> Its employees or agents, for any alleged violation of any such condition, regulation, or <br /> law, as well as any costs and attorneys fees incurred by Landlord as a result of the <br /> prosecution or litigation of any such claim. If any such condition, regulation or law is <br /> violated by Tenant or its agents, then Landlord, at its option. may, notwithstanding any <br /> provision of this Agreement to the contrary, immediately terminate this Agreement. <br /> Tenant reserves the right to monitor and regulate the alcohol consumption of the general <br /> public. <br /> 7* RECORDS <br /> Accurate records and accounts shall be kept by Tenant for the purpose of verifying the <br /> amount due Landlord. Tenant shall famish to Landlord, weekly, true and accurate <br /> statements of the gross receipt of Tenant from -busffiess conducte'd upon the Premises. <br /> Tenant's "Z" reports (unless other report permitted by Landlord in writing, i.e. use of <br /> gross receipts sales report or cashier report) are due to Landlord on a Monday through <br /> Sunday basis no later than 12:00 p.m. on the following I i uesday. Landlord shall assess a <br /> late fee of$50.00 per day for each day the sales report is late or delinquent. Format of <br /> Landlord's sales report is attached hereto and made a part hereof. Landlord shall have <br /> the right at any or all times to examine the books, cash register tapes, sales record, -profit <br /> and loss statements and all other financial and business records maintained by the Tenant <br /> including Tenant's Federal Form 1040, Schedule C income tax returns and sales tax <br /> reports. If such audit disclosed a liability for rent, three percent (3%) or more in excess <br /> of the rent theretofore paid by Tenant, the cost of said audit, in addition to the deficiency <br /> in rent,, shall be paid by Tenant within ten (10) days of notice to Tenant. The deficiency <br /> shall be payable in any event'Within ten (10) days of written notice to Tenant. <br /> 8, CHANGES TO MARKETPLACE <br /> Landlord reserves the right to make changes or revisions to the site plan at any time., <br /> including additions to, subtractions from, or rearrangements of the buildings and lands, as <br /> shown on Exhibit A, attached hereto and made a part hereof, so long as the same does not <br /> materially interfere with the Tenant's use of the premises. - Landlord agrees that any <br /> planned changes or revisions to the site plan which wilt occur prior to or during the lease <br /> term have been disclosed to the tenant prior to si*gm*ng this lease. In the event that an <br /> unplanned change or revision is necessary, Landlord agrees to notify Tenant <br /> immediately. In the event that it materially interferes with the Tenant's use of the <br /> premises, Tenant may show cause and cancel lease. <br /> 91 IMPROVEMENTS AND FIXTURES <br /> Tenant shall not make any additions or alterations to the leased Premises which will <br /> affect the appearance of the exterior or interior of the Premises or which will affect any <br />
