69 <br />Action: Motion made and seconded that this article be <br />postponed indefinitely. Voted unanimously. <br />Article 37. To see if the Town will vote to raise and <br />appropriate the sum of $4,300.00 to purchase a Highway <br />Department dump truck or take any other action in relation <br />thereto. <br />Action: Article accepted as read: Voted 31 for, 15 opposed. <br />Article 38. To see if the Town will vote to raise and <br />appropriate the sum of $800.00 for the construction of a <br />small boat launching ramp at the end of Mashpee Neck Road, <br />Popponesset Bay or take any other action in relation thereto. <br />Action: Article accepted as read. Voted unanimously. <br />Article 39. To see if the Town will assume liability in the <br />manner provided by Section 29 of Chapter 91 of the General <br />Laws, as most recently amended by Chapter 5, Acts of 1955, <br />for all damages that may be incurred by work to be per-. <br />formed by the Department of Public Works of Massachusetts <br />for the improvement, development, maintainance and pro- <br />tection of tidal and non -tidal rivers and streams, harbors <br />tidewaters, foreshores and shores along a public beach, <br />outside of Boston Harbor including the Merrimack and <br />Connecticut Rivers, in accordance with Section 11, of Chapter <br />91 of the General Laws, and authorize the Selectmen to <br />execute and deliver a bond of indemnity therefore to the <br />Commonwealth. <br />Action: Article accepted as read. Voted unanimously. <br />Article 40. To see if the Town will vote to accept the <br />layout of Ninegret Avenue so called, running in a northerly <br />direction from Route 151 and Crow Road, so called, for a <br />distance of 3,045.45 feet at the southerly end of John's Pond <br />in the John's Pond development for a Town way and will <br />authorize and instruct the Selectmen to take by purchase <br />or eminent domain in behalf of the Town the land or interests <br />in land within the lines of said layout for this purpose and <br />will raise and appropriate a sum of $100.00 for land damages <br />incurred or take any other action thereon. <br />Action: Article accepted as read. Voted unanimously. <br />
