DIV <br />Section 3. Title. These by-laws shall be known as the Mashpee <br />Building Code, <br />Section 4. Continuance of Former By -Laws -Repeal. The provisions <br />of these by-laws, so far as they are the same as those of existing by- <br />laws, shall be construed as continuations thereof and not as new enact- <br />ments. A reference in a by-law, which has not been repealed, to pro- <br />visions of by-laws which are revised and re-enacted herein shall be con- <br />strued as applying to such provisions as so incorporated herein. All by. <br />laws or parts of by-laws heretofore passed, inconsistent herewith, are <br />hereby repealed. <br />Section 5. Validity. The invalidity of any section or provision of <br />these by-laws shall not invalidate any other section or provision thereof, <br />Section 6. Amendments. These by-laws may be amended from <br />time to time by a two-thirds vote at any Town Meeting. <br />CONSTRUCTION <br />REGULATIONS. <br />Section 1. Notification of intent to Build, etc. <br />Fara. 1. A permit shall be required for all buildings to be erected, <br />altered, reconstructed or moved to a new foundation within the limits <br />of the Town of Mashpee, excepting small unattached accessory buildings <br />not to be used for the purpose of habitation and having a floor space of <br />less than 100 square feet. <br />Para. 2. This code shall not apply to: 1. Buildings for which a Com- <br />monwealth of Massachusetts permit is required. 2. Buildings or struc- <br />tures owned by the United States or the Commonwealth of Massachu- <br />setts. S. Bridges, quays, wharves. 4. Farm buildings or structures not in <br />either case used as dwellings and located more than 100 feet from any <br />d -welling, if approved by the Building Inspector. 5. ordinary repairs to <br />buildings, providing such repairs do not include the removal of walls <br />which tend to weaken the building. <br />Section 2. Applications. Applications for building permits shall <br />be accompanied by a plan of the lot showing the dimensions of the lot <br />and the location and size of the building or buildings to be erected, to- <br />gether with location of cesspool or septic tank and water supplies. A <br />record of such applications and plans shall be kept on file in the office <br />of the Building Inspector. <br />Section 3. General Provisions Applicable to All Buildings. <br />Para. 1. All wooden construction in buildings hereafter erected shall <br />be built with sills, posts, studs and plates properly braced and framed <br />so as to develop the maximum strength and regidity consistent with the <br />purpose for which they are to be used. <br />Para, 2. All materials used shall be of sufficient strength and size <br />to safely carry the loads they may be subjected to without exceeding the <br />allowable working strength. 1. All lumber and timber used in load bear- <br />ing members shall be sound, free from rot and large or loose knots, and <br />damaged diagonal or spiral grain; and shall be at least equal in quality <br />to the following commercial grades; studs, posits, planks, beams, joists <br />and rafters, 110. 2 Con -1011. and girders and timbers No. 1 Common. All <br />lumber sizes herein specified are nominal sizes. <br />Para,. 3. Excavation. 1. All excavations shall extend to solid ground. <br />2. All excavations shall extend at least 18," below the finished grade. <br />Para. 4. Footings. 1. All footings must be masonry. 2.
