68 <br />ments to the community use of the owners of the lots <br />within the development tract; or to a membership cor- <br />poration, trust or association whose members are all the <br />owners of the lots in the tract; or the Town. No struc- <br />ture shall be erected thereon excepting structures in- <br />cidental to the above uses, and no such structure shall <br />be more than fifteen feet in height. <br />7. Each application for a special permit hereunder shall be <br />accompanied by a plan of the cluster development pre- <br />pared in accordance with the specifications of the Plan- <br />ning Board for preliminary subdivisions plans (whether <br />or not all of the development constitutes a subdivision.) <br />The Planning Board may, in appropriate cases, impose <br />further restrictions upon the tract or parts thereof, as a <br />condition of its approval. <br />8. Approval of a cluster development is primarily an au- <br />thorization for the use of lots which have less than the <br />required minimum area and/or frontage. Approval by <br />the Planning Board of such portions of the development <br />as constitute a subdivision will be required as set forth <br />in the subdivision control law and in the rules and regu- <br />lations governing the subdivision of land in the Town <br />of Mashpee. <br />9. Any condition set forth herein requiring a minimum lot <br />area or minimum average width shall not be construed <br />as purporting to limit the right of the Board of Appeals <br />to grant a variance there from as permitted by law. <br />Action: Motion made and seconded to accept article as <br />read. Voted 14 for, 170 opposed. <br />Article 19. To see if the Town will vote to amend the <br />zoning by-laws of the Town of Mashpee by deleting F-lla <br />and inserting the following: <br />(a) Size of Lots—No building shall be erected on a lot less <br />than seventy-five (75) feet in minimum average width <br />and containing less than seventy-five hundred (7500) <br />square feet.
