Rules and Regulations, relative to the dredging or filling of <br /> waterways, and marshlands within the Town which reads as follows: <br /> Section 1. All applications for a permit to dredge or fill must conform <br /> with State and Federal statutory rules or requirements with reference <br /> i <br /> to navigable waters. <br /> Section 2. All applications must be in writing or on a•form prepared <br /> by the Board of Selectmen and available at the office of the Town Clerk <br /> and shall be accompanied by a filing fee of ten dollars. <br /> Section 3. An application for a permit shall state: <br /> a. The name and address(s)of the land affected. <br /> b. The exact area sought to be dredged or filled, <br /> j identifying by landmarks or monuments or by <br /> an accurate plan or survey of the land, marsh, <br /> or waterway affected. <br /> Section 4. A public hearing shall be held on every application, which hearing <br /> shall be advertised at least seven days before the date of the hearing. <br /> Section 5. Any person violating the provisions of the By-law shall be <br /> punished by a fine not to exceed$20.00 for each offense. <br /> i, <br /> ACTION: Motion duly made and seconded to accept Article 60 as read. So voted. <br /> 1 <br /> Article 61: To see if the Town will vote to add to & adopt the following <br /> amendment to the Mashpee Conservation By-law, the following: The Conser- <br /> vation Commission may require the posting of a bond with surety, running to <br /> the municipality, and sufficient as to form and surety in the opinion of the <br /> Commissions' Counsel, to secure faithful and satisfactory performance of work <br /> required by any final "Order of Conditions" in such sum and upon such condi- <br /> tions as the Commission may require. Other evidence of financial responsibility <br /> j which is satisfactory to the Commission may be accepted in lieu of bonding. Not- <br /> withstanding the above, the amount of such bond shall not exceed the estimated <br /> cost of the work required or the restoration of affected lands and property if the <br /> work is not performed as required, whichever is the greater. Forfeiture of any <br /> such bond shall be recoverable at the suit of the municipality in the Superior <br /> Court, or take any other action thereon. <br /> ACTION: Motion duly made and seconded to accept Article 61 as read. So voted. <br /> Article 62: To see if the Town of Mashpee will vote to authorize the Town by <br /> its Historical Commission to apply for and receive Federal, State and Private <br /> Grants and accept donations from public or private sources for museum purposes, <br /> with the approval of the Selectmen or take any other action thereon. <br /> ACTION: Motion duly made and seconded to accept Article 62 as read. So voted. <br /> Article 63: To see if the Town will vote to accept Hooppole Road as a public <br /> road in the Town of Mashpee. <br /> ACTION: Motion duly made and seconded to indefinitely postpone Article 63.
