Mr. Balzarini inquired whether that meant there would be time to complete the intersection and Mr. <br /> Rowley responded that, at the last meeting, Mr. Lehrer agreed to coordinate planning for the <br /> intersection between Ms. Laurent and Mr. Marsters. Today's security amount would be for work <br /> completed to date. The Chair inquired about the suggested improvements to the intersection at Old <br /> Barnstable and Mr. Lehrer confirmed that he had followed up with Mr. Marsters about the intersection, <br /> but that restrictions from the pandemic prevented the coordination of a meeting. Mr. Marsters stated <br /> that he was willing to work with the Town on the intersection, noting that the plan had already been <br /> established. Mr. Marsters added that the intersection would be addressed before the addition of higher <br /> rates of traffic. Mr. Rowley also recommended removal of vegetation on the southerly side of the <br /> intersection, improving the sight line. Mr. Marsters confirmed that they would remove the vegetation <br /> and were also working on signage with lighting. Mr. Marsters also indicated that he would discuss <br /> with Ms. Laurent and work with the golf course regarding removal of vegetation on their property. <br /> There was consensus from the Board that Mr. Rowley continue to work with Mr. Marsters on this <br /> project. Mr. Marsters confirmed that he would deliver a check to Mr. Lehrer on the following day. <br /> MOTION: Mr. Balzarini made a motion for a Release of Covenant for 26 lots with a security of <br /> $243,357. Mr. Callahan seconded the motion. <br /> Mr. Rowley inquired about establishing a time limit for completing the work and Mr. Marsters <br /> responded that he was unsure of the binder, and wished to build the houses before the finish coat, but <br /> noted that some of the work had already been completed. Mr. Rowley suggested including a two year <br /> limit in the motion, with a review at the end of two years. The Chair inquired whether the paper work <br /> allowed for a time limit and Mr. Lehrer responded that the document did not allow for conditions. Mr. <br /> Rowley stated his belief that it was a general Condition of Statute,but if the Board did not see it as <br /> necessary, it was not a requirement. The Chair noted the benefit of a time limit as the costs for <br /> construction would increase over time. Mr. Marsters stated that he was very motivated to complete the <br /> work as soon as possible and the Chair suggested that the Board place a two year limit for the security <br /> but Mr. Marsters asked that there be a review at two years or sooner. Mr. Rowley stated that it would <br /> be acceptable. Mr. Balzarni agreed to a two year review rather than a limit. <br /> MOTION: Mr. Balzarini made a motion to give a two year review process to see how far the <br /> project has gone, to return funds, but that, in between the two years, he could return to the <br /> Board for funds for work completed. The amount of$243,357 would be accepted as a bond for a <br /> Release of Covenant for 26 lots as shown on the map. Mr. Callahan seconded the motion. Roll <br /> call vote: Mr. Balzarini-yes; Mr. Cummings-yes; Mr. Callahan-yes; Chairman Waygan-yes <br /> Mr. Lehrer coordinated acceptance for the security. <br /> OLD BUSINESS <br /> Request for reduction in performance bonds held for Definitive Subdivisions known as <br /> The Cottages Phases I, II and III-John Falacci, Bayswater Development, LLC, was present remotely <br /> to discuss the request for the bond release and reduction. Mr. Falacci stated that he had been in contact <br /> with Mr. Rowley, and had no issues with his findings. The Chair inquired about Mr. Rowley's <br /> concerns expressed in April regarding plan revisions to include bounds and monumentation with <br /> certification and Mr. Rowley confirmed that the bounds appeared in Mr. Lehrer's file. Mr. Rowley <br /> referenced his June 1 letter, based on his inspection of the stormwater area, recommending the amount <br /> provided by Mr. Falacci's estimate from Pastore Construction, for a total amount of$77,250.
