May 1, 1963, recorded at the Barnstable County Registry of Deeds in Book 1199, Page 497, to
authorize the Selectmen to negotiate and execute any agreements or instruments necessary to
complete this transaction, or take any other action related thereto.
Submitted by the Board of Selectmen
Explanation: This article authorizes the Board of Selectmen to acquire by gift a parcel of land
owned by Commonwealth Electric needed to layout, and construct the signalization of the Route
28/Orchard Road intersection.
The Board of Selectmen and the Finance Committee recommend approval.
Motion made by Don Myers.
Motion: I move Article 17 be voted as printed in the warrant, except for the phrase "or take any
other action relating thereto".
Motion passes unanimously at 8,1:46 PMO
Article 18
To see if the Town will vote to amend the Zoning By-law by adding a reference to footnote 22 in
the heading of the "Front" column under "Minimum Building Setback to of Lines" in the
Section 174-31 Land Space Requirements Table and adding the following new footnote 22 to the
footnotes to said Table:
"22 Minimum front building setback within the Mashpee Center Overlay District shall be 20
feet and maximum allowed building setback for the principal structure on a lot shall be 40 feet." ,
or take any other action relating thereto.
Submitted by Planning Board
Explanation: This article would correct a duplication of footnote numbering in the dimensional
requirements table of the Zoning By-law which was created by a petition article approved at the
October 2002 Town Meeting, which inadvertently replaced a previously approved footnote 20
(now proposed as footnote 22) with a different footnote 20. The footnote proposed provides for
reduced setbacks (20 ft. minimum, 40 ft. maximum) in the Mas,hpee Center Overlay ;one, and
was previously adopted under Article 29 of the October 1999 Town Meeting.
The Board of Selectmen and the Finance Committee recommend approval.
Planning Board voted at a Public Hearing held on October 5, 2005 4-0 to recommend
approval.
Motion made by John Cahalane.
18
