Motion: I move Article 18 be voted as printed in the warrant, except for the phrase "or take any <br /> other action relating thereto". <br /> Motion passes unanimously at 8:48 PM <br /> Article 19 <br /> To see if the Town will vote to amend the Zoning By-law by <br /> Adding the following definition under the definition of"Apartment" in Section 174-3.A.: <br /> 44(5) ACCESSORY APARTMENT — an apartment created within a single-family residential <br /> structure under the provisions of Section 1,74-4,51.4"; <br /> Amending the definition of "Accessory Dwelling' contained in Section 174-3.A to 'read as <br /> follows: <br /> "(7) DWELLING, ACCESSORY - A residence created under the provisions of Section 174- <br /> 46.B.(I), containing no more than one (1) bedroom, which may have kitchen and bathroom <br /> facilities and other rooms which are not bedrooms, either attached to or detached from a <br /> principle residence on the same lot and not owned separately from the lot or principle <br /> residence. Such dwellings may not be occupied by more than two (2) persons." <br /> Amending the first sentence of Subsection 174-45A.C. to read as follows: <br /> "The design, installation, use of an accessory apartment shall be secondary and incidental to the <br /> principal use of the structure as the owner's home, and the apartment shall be located within the <br /> same structure as said home."; <br /> or take any other action relating thereto. <br /> Submitted by Planning Board <br /> Explanation: This article would clarify that accessory apartments are to be located within the <br /> same structure as the principal residence with which they are associated and that they are not the <br /> same as "accessory dwellings" permitted under the 0 SIB by-law. <br /> i The Board of Selectmen and the Finance Commttee recommend approval. <br /> Planning Board voted at a Public Hearing held on October 5, 2005 4-0 to recommend <br /> approval. <br /> Motion made by Theresa Cook. <br /> Motion: I move Article 19 be voted as printed in the warrant, except for the phrase "or take any <br /> other action relating thereto". <br /> Motion made to dispense with reading of article. <br /> 19 <br />
