MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> FEBRUARY 24,2021 <br /> Mr. Furbush announced that the four regular Board members and George Ganzenmuller <br /> will be sitting in on this hearing. <br /> 104 Popponesset Island Road: Petitioners, Carol A. and Jerry Bellis request a Special <br /> Permit under §174-17.1 to remove and replace a single family non-conforming residential <br /> structure on this non-conforming lot with a new code compliant five bedroom residence on <br /> property located in an R-3 Zoning District, Map 112 Parcel 3, Mashpee, MA. (Owner of <br /> Record: Carol A. Bellis, as Trustee of the Anthony P. Gargiulo Irrevocable Trust of 2012). <br /> Attorney Kevin Kirrane represented the applicants for this raze and replace project. This <br /> lot is located on Popponesset Island Road and consists of 24,000 sq. ft., with 125 ft. of <br /> frontage. The site is improved with a four bedroom residential structure, and sits 14.9 ft. <br /> on it southerly side line, and 34 ft. from one coastal bank, and a secondary coastal bank. <br /> The side yard is 14.9 ft. (15 feet is required), and its setback from the wetland resource <br /> areas is 34 ft., and 0 ft. (50 ft. is required) and is considered non-conforming. <br /> The applicants want to replace the mid-seventies structure with a new two-story, four <br /> bedroom home which eliminates the side yard non-conformity by increasing the setback to <br /> 23.4 ft., and maintains the existing wetland setback. The project was approved by the <br /> Conservation Commission, and will have a new Title 5 septic system installed. There are <br /> no new non-conformities being proposed. <br /> The Board reviewed the site plan and had no issues. Mr. Bonvie confirmed the lot coverage <br /> being 16.05%to 15.93%. <br /> Mr. Gould read the Board of Health comments into the record. Sharon read the <br /> Conservation Comments into the record. <br /> Mr. Bonvie made a motion to approve a Special Permit to Carol A. and Jerry Bellis at 104 <br /> Popponesset Island Road under §174-17.1 to remove and replace a single family non- <br /> conforming residential structure on this non-conforming lot with a new code compliant <br /> five bedroom residence on property located in an R-3 Zoning District, Map 112 Parcel 3, <br /> Mashpee, MA. (Owner of Record: Carol A. Bellis, as Trustee of the Anthony P. Gargiulo <br /> Irrevocable Trust of 2012) with the following conditions; <br /> 1. The Board has determined that the applicant meets all the conditions of a Special <br /> Permit under Mass General Law 40A Section 9. <br /> 2.
