The lots have been sold and are now privately owned. <br /> Bruce Besse confirmed said lots have been sold to <br /> private homeowners or contractors, and Willowbend would <br /> have no control over which roads they chose to use. <br /> Applicant can recommend certain roads not be used for <br /> construction purposes, however they would have no direct <br /> control once the property has been sold. <br /> The Town Planner asked if said road issues had been a <br /> condition of Zoning Board of Appeals lot size variances . <br /> Attorney icElhinney could not recall, a number of <br /> variances had been granted, and there had been discussion <br /> with the neighbors . He agreed to look into this matter. <br /> further (drainage work) , stating App'licant would life to be <br /> a good neighbor. <br /> Mt. Harris responded to the question of <br /> responsibility, stating Applicant is the recipient of <br /> special permits/variances from the Town and that they are <br /> in fact responsible to control con traction matters . The <br /> Bay Ridge Association has contacted Applicant numerous <br /> times in an attempt to discourage construction access of <br /> Simons Narrows Road (flatbeds, excavator's, 10-wheelers, and <br /> liner- trucks) . Said attempts failed, and h feeds that <br /> the damage to catch basins on Simons Narrows Road is a <br /> direct result o:f such construction use. <br /> The Town Planner suggested the Zoning Board- of Appeals <br /> variance documents be reviewed in or-der to -determine the <br /> exact language used. <br /> Sarah Gorczyca, Shipwreck Drive - Expressed her <br /> concern regarding the use of public ways, when private <br /> developers change the route of public roads. She mentioned <br /> the gate at Simons Road, across a public road. She feels <br /> public (ancient) ways should, remain open to the public <br /> without change, and not become a Willowbend subdivision <br /> road. She mentioned the speed bumps on Willowbend Road. <br /> The Town Planner clarified a portion of Willowbend <br /> Road is public, the speed bumps are looted on the private <br /> subdivision portion of the road. <br /> 6 <br />
