He offered to include language within the road covenant <br /> that would accept responsibility for maintenance issues of <br /> the roadway beyond the gate in order ,to insure emergency <br /> access. <br /> The Chairman determined the plan -nee-ds to be modified <br /> to show the gate, and prepare the covenant to include <br /> maintenance responsibility language. <br /> There being no further Board or Public comment the <br /> Chairman entertained a motion. <br /> MOTION: Dennis Bal arini made a Motion to continue <br /> the Public Hearing in this ratter to Ma-rch 2, 2.005 at 7 <br /> p.m.; which Motion was duly seconded by John Haiachis and <br /> o voted un .nimou l . <br /> Public Tearing <br /> Lincoln Way Fealty Trust <br /> Spring Meadow Subdivision <br /> Approval of Definitive Plan for Lot 3A and Lincoln Way <br /> The appointed hour having arrived the Chairman called <br /> the Public Hearing to order. <br /> The Chairman recognized Mike Aucoin, representing the <br /> Applicant, who requested roadway approval for Lincoln Way. <br /> He stated the abutters have been satisfied regarding <br /> drainage concerns and have provided a right of way. The <br /> Fire Department and DPW concerns have been addres-sed:. The <br /> covenant matters have -been addressed with the Town Planner. <br /> He has been in communication with the Consulting Engineer <br /> regarding finalization of the roadway details . <br /> The Town Planner suggested bath the road construction <br /> covenant and the road maintenance covenant be referenced on <br /> the plan. <br /> When asked, Mr. Rowley informed the Board there are a <br /> fear minor outstanding issues to be resolved. He suggested <br /> the Board allow him to work directly with applicant' <br /> engineer in order to address these issues; to which the <br /> Board agreed. <br /> There being—no further Board or Public comment the <br /> Chairman entertain'ed a motion. <br /> 11 <br />
