The <br /> original footnote appears to have been deleted when the <br /> second footnote was adopted. <br /> The Town Planner suggested the original footnote 20 be <br /> reinstated as it refers to front setback requirements <br /> within the l ashpee Center Overlay District; to which the <br /> Board agreed. <br /> BA Findings - The Bylaw specifies the Zoning Board of <br /> Appeals should not be issuing Special Permits, but rather <br /> -make a Finding following the procedure for Special Permit . <br /> The proposed Article would help to make this <br /> distinction/clarification. <br /> Where is- also a Finding listed in the Table of Uses <br /> for Zoning Board of Appeals to review uses that are not <br /> listed within the Table of Uses to discern whether the use <br /> is similar to something listed. Again, this matter is <br /> listed as Special Permit and should be identified as a <br /> Finding. <br /> The Town Planner suggested he review this matter with <br /> both Town Counsel and the Chairman of the ZoningBoard of <br /> Appeals . Clarification is to be made that the ZBA issue a <br /> Finding and that the Planning Board issue the Special <br /> Permit. <br /> Other Possibilities <br /> Fertilizer Application Bylaw - The Torn Planner <br /> suggested this be adopted as a general bylaw rather that a <br /> zoning bylaw. <br /> The Town Planner was unsure as to whether or not he <br /> would be able to draft this proposed bylaw within the time <br /> frame for submission. The Chairman suggested this issue <br /> might be able to be addressed -under the DCPC, nitrogen <br /> is-sue. <br /> 7 <br />
