This matter concluded at :20 p.m. ) <br /> NR-Shirley Poters-Continuation <br /> The Board apprised the Consulting Engineer of the issues, <br /> requesting his determination in this Land Court matter. <br /> The Consulting Engineer determined that in order to have <br /> said plan signed as an Approval Not Required would be to obtain <br /> Planning Board determination as to whether the access ,is <br /> adequate; whether it is a way in existence prior to the adoption <br /> of subdivision control; whether it is a public way, or a way <br /> shown on a previous plan. <br /> e stated the Board would have to make a judgment as to <br /> whether or not the road is adequate to service the lot in <br /> question under 1- LL. <br /> After some discussion the Board suggested Applicant withdraw <br /> her application and resubmit it at the next scheduled Meeting <br /> September th as the matter must be addressed within 2 1-days of <br /> filing/acceptance by the Board. The Board requested the <br /> opportunity to contact the DPW Directd'r and the Fire Department <br /> to determine if the road has been in use by the Town. <br /> There was some discussion regarding road adequacy issues. <br /> The Consulting Engineer suggested Applicant request the <br /> Surveyor sign the plan a "lines of existing ownership' , that <br /> there are no new limes for the division of existing ownership,, <br /> or for lines of streets or ways. He also suggested the Surveyor <br /> contact the. Land Court for guidance as this is a Petition Plan. <br /> In the event Applicant is referred back to the Planning <br /> Board', she was advised to contact the Planning Department for <br /> inclusion on the agenda for the September- 20, 2000 Meeting as <br /> Applicant advised she would not be available to attend the <br /> September 6th Meeting) . (This matter concluded at 8:38 p.m. <br /> Board Items <br /> vote for Associate Member <br /> The Town Planner reported that Steven Dolan is the only <br /> applicant for the position of Associate Member to the Planning <br /> Board. <br /> Robert Shea has notified the Pla=ing Department, In <br /> r-i t ing, of his appointment to the Conservation Commission, and <br /> subsequent withdrawal for consideration -to the Planning Board. <br /> MOTION: Martine Meij ering made a Motion to appoint <br /> - - <br />
