It is seconded by Jim and carried <br /> unanimously. 4 <br /> Chairman introduces the next order of business, Article 28 which would allover age- <br /> restricted congregate care or assisted living residential facilities-in any residential or <br /> commercial zoning district by special permit from the Planning Board under the same <br /> process that currently applies to hotels, motels, hospitals, infirmaries, nursing homes, <br /> convalescent homes and similar uses. It also adds definitions of those uses. <br /> Jim begins discussion by saying that he is opposed to this zoning article because.he <br /> feels that it would pose future inconveniences to area residents. He reads from a memo <br /> he composed. He explains that this article would make it allowable to change existing <br /> commercial zoning legs involving the zoning of assisted living congregate care facilities. <br /> He explaint that they are money raking businesses that promote heavy traffic and <br /> should be zoned as such. He would like the board to reconsider and vote against this <br /> article change. <br /> Chairman asks if there are any objections either from the Board or from the public in <br /> removing from the article references to "residential.' <br /> Torn restates that this article would, indeed, allow for the zoning of assisted <br /> living congregate care facilities in virtually any area of Mashpee. He reiterates that we <br /> could take out the word "residential" from the article and leave these types of facilities in <br /> commercial zoning areas only. <br /> Chairman recognizes Vicki Peters, a visiting nurse who works with Alzheimer's patients. <br /> She says that these patients can be very noisy, can be negligent with garbage disposal, <br /> and can pose general,nuisances for nearby residents. <br /> Chairman entertains a motion from the Board. <br /> Motion by Dennis to recommend the article with the exception of removing all <br /> references to "residential." Motion seconded-by Beverly and carried unanimously. <br /> As suggested by Torn, Chairman explains that because of the way the previous article <br /> is worded we also have to adjust the references in the article if it goes to the floor. <br /> Town Planner introduces Article 29. He explains that this article attempts to provide a <br /> clear explanation of what type of zoning applies to a piece of property that is split by <br /> zoning district boundaries and hover the zoning applies to the larger portion of the lot. He <br /> sags there is a lot of lots in torn that are split in this gray. He reads from the article and <br /> eplains it in detail. <br /> Chairman asks if them are any comments or questions from the public. <br />
