i <br /> r <br /> McElhinney responded that their surveyor,who has been with Willowbend for years, <br /> had just switched firms which caused a bit of a complication. He did submit the <br /> certification with the plan, and, in fact, did come to talk the Planning Board. Mr. Fudala <br /> responded that the surveyor had given the board letters and as a separate sheet had given t <br /> the certification. Mr. McElhinney said that Willowbend would be happy to print the <br /> abutters list on the actual plan. Mr. Malone asked about the curb? Mr. McElhinney <br /> stated they would ask for a variance relative to the curb. Mr. Fudala reiterated that the <br /> abutters must be on the plan, not submitted as an abutters list. Mr. Kuchinski stated that <br /> there were two,perhaps three, options for Willowbend: one would be to continue to <br /> 11/17/99, one would be to deny, and one would be for Willowbend to withdraw the <br /> plans. Mr. Kuchinski listed what documents the board has from Willowbend: <br /> application, a surveyors certificate, $3 5 o fee, Form D (in triplicate), and an abutters list <br /> for both preliminary plans submitted. Mr. Balzarini suggested Willowbend continue to <br /> 11/17/99. Mr. Malone asked why the board was not concerned about the radius for one <br /> of the turns? Mr. Dorgan asked what the radius is? Mr. Kuchinski indicated the radius <br /> looked to be about a 30 ft. rounding. Mr. McElhinney stated that was a cul-de-sac that y <br /> was originally included, thinking it may have been a planning board requirement. Mr. <br /> Fudala replied it was needed because there was a lot that needed frontage; it wasn't a <br /> radius, it was an intersection. Mr. Dorgan asked if this is within the confines of <br /> Willowbend? Response indicated that it was in the Shoestring Bay subdivision. <br /> Response from Mike was they could take a look at the radius or make it a stop <br /> condition. Mr. Kuchinski is concerned about setting a precedent for other subdivisions. <br /> Mr. McElhinney indicated Willowbend will be happy to look at the design. A decision, <br /> by the Planning Board,must be made by 11/18/99 to be within the 45 days. If a <br /> decision is not filed by the Planning Board within 45 days,the plan is automatically <br /> approved as a preliminary plan; however, the board can extend it. The decisions are <br /> supposed to be made at the preliminary plan stage,not at the definitive stage. Mr. <br /> Fudala indicated there has been no report from the Board of Health. Mr, McElhinney <br /> responded that Willowbend has filed with the Board of Health. on the current <br /> preliminary plan, there are no drainage calculations. The important points,per Mr. <br /> Dorgan, are radius, named abutters, stormwater drainage,buffers, and drainage. <br /> Willowbend will change plans per C. Rowley letter comments. Mr. Fudala indicated <br /> that on the preliminary plan as submitted, street layout is altered; plans should show old <br /> plans with dotted lines. Mr. McElhinney feels that this is a new subdivision, not <br /> modifying an old one. Mr. Fudala feels that Willowbend is modifying; Mr. McElhinney <br /> does not. Mr. McElhinney stated that this is two sets of plans on top of each other. Per <br /> Mr. Fudala, a developer cannot have two sets of plans. only one set of plans can be <br /> shown. Willowbend will return on 11/17/99 with revised preliminary plans. <br /> a <br /> y� <br /> r <br />
