■ <br /> The Chairman recognized Attorney John Kenney,, <br /> representing Industrial Communications and Electronics, <br /> Inc. hereinafter referred to as I-CE) , who submitted -copy <br /> f a document issued by the Cape Cad Commission indicating <br /> this case has- been closed. He then acknowledged submission <br /> f Planning Staff draft Decision. He made himself <br /> available to answer any Board questions . <br /> Draft Special Permit Decision - May 21, 2003. The <br /> Assistant 'down Planner addressed the following: <br /> Findings - Owner verification of land use, as well a <br /> authorization of certain individuals to sign the <br /> Application. Site plan indicating a 1 -ft . fall zone <br /> easement and a -ft. buffer . Concealment of the equipment <br /> shelter in compliance ,with the By-law. There are no <br /> landscaping issues . -Sample lighting has been provided. <br /> Concerns regarding noise limits have been satisfied b <br /> construction of a 1 --f t. solid wood fence . Radio frequency <br /> reports are required. A grater quality report ha-s been <br /> provided. <br /> Conditions - No Certificate of Occupancy may be issued <br /> _ until such.. -time. _as. _t ie Cape- -Cock- Commission - a-s Issued a �Certificateof Compliance. Type of lighting and <br /> identification sign. Hazardous materials restrictions. <br /> Language change to , "proposed" co-locators, delete "may <br /> include" . Special Permit Modifications are required for <br /> any changes within the Special Permit . radio frequencies, <br /> noise measurements, maintenance and discontinued. operations <br /> were addressed.. <br /> There wa-s some discussion regarding securities . It <br /> was decided to delete the NOTE from 1 , <br /> Attorney Kenney suggested the following language • <br /> change for #1 : "...Limit to current technology currently in <br /> use by these Departments, and the Applicant will use <br /> reasonable efforts to accommodate changes in technology for <br /> the Town, provided there is no interference by private <br /> carriers..."' The Board suggested a further change, "...shall _ <br /> -lave space at no cost..." <br /> The Town Planner reported notification has been <br /> received from the Military Base regarding possible <br /> relocation of the radar tower to a location approximately <br /> 2, 000 f t . from Applicant' s proposed location. <br />
