The Chairman recognized Don Cody, Director of <br /> Operations, ICE, who responded their primary concern had <br /> been with conflict of frequencies . Anticipated range of <br /> frequencies were provided by ICE at which time- the Military <br /> determined- there was no reason for concern, and thatt they <br /> would forward the information to the FAA for verification. <br /> Attorney Kenney clarified that although the use of the <br /> space will be provided to the Town at no cost, the Town <br /> will be responsible for the installation costs . <br /> Public Comment <br /> The Chairman recognized Attorney Andrew singer, <br /> Dennisport, MA, representing Peter watts, who commented on <br /> portions of the as.hpee .By-law, Findings #6 and # . <br /> He spoke - Applicant' s burden to establish there are <br /> no feasibly existing structures on which to locate . He <br /> requested, as part of the process, the Board review these <br /> Findings . <br /> Attorney singer made reference to the existing Town of <br /> iashpee water District tank which is located on Bach load; <br /> and the existing Meetinghouse Road Mashpee Water District <br /> tank (of which pictures have been provided to the Board) . <br /> He noted the proximity of both of these structures to the <br /> proposed Echo Toad location. <br /> He suggested that perhaps the tower being proposed is <br /> not needed, or may be sufficient at a lower height. He <br /> also spoke to the visual impacts of the proposed toner. <br /> Dennis Balarini determined that the Meetinghouse Road <br /> tower was not in existence (completed) at the time of <br /> Applicant' s filing, noting it would be unreasonable for the <br /> Board to require data at this point in the process . <br /> Attorney singer argued it would be appropriate, prior <br /> to closing the Hearing/Decision to complete the Record and <br /> investigate that all existing structures have been taken <br /> into account . <br /> The Chairman recognized Mir. Cody, ICE, who suggested- <br /> the previous speaker' s intent is to further delay the <br /> 8 <br />
