The Chairman declared a five-minute recess at this <br />point ( : 0- :2 .m., ). <br />Discussion Items <br />Southport Modification Process <br />Recommendations - ZBA and Planning Board Subcommittee <br />The Chairman explained the purpose of this discussion, <br />Southport Special Permit, granted by the Zoning Board of <br />Appeals, is to determine/clarify responsibility for various <br />aspects of said Special Permit/Southport project. <br />A joint meeting was conducted on September 23, 2003, <br />with Bob Nelson and Marshall Brem, Zoning Board of Appeals; <br />Beverly Kane and Dennis Bal arini, Planning Board; as well <br />as the Town Planner, Mr. Fl. The Building Inspector <br />was unable to attend. <br />The original Special Permit was issued by the Zoning <br />Board of Appeals under what was known at the time as "The <br />Planned Retirement Community Zoning Bylaw". <br />modification was granted by the ZBA to the original Special <br />Permit in January of 1985, at which time Condition #30 was <br />-inc-orporated. -T-his- Condition- which- expanded, upon the <br />requirements for the final site development plans and added <br />a requirement that said plans also be submitted to the ZBA <br />for approval, prior to Planning Board approval. <br />The Chairman explained how the approval process with <br />proceed from this date forward <br />BA approval of the Special Permit decision including <br />Conditions and a Master Site Development Plan. <br />Submission of final Site Development Plans, including <br />the contents required by the PRC By-law, as well as the <br />conditions of the Special Permit including the requirements <br />annexed to the Decision under Condition #30 to both the ZBA <br />and the Planning Board for approval (developed s <br />requirements) . <br />The ZBA must approve the final Site Development Plans <br />before the Planning Board can approve the plans, which is a <br />conditional approval. <br />Recommendations: In order to avoid unfair damages t <br />innocent third parties who purchased units prior to the <br />1 <br />
