Mr. Fudala responded that the <br /> Planning Board decides if it is under old or new bylaw. Mr. Kuchinski thought it was a <br /> modification of the Special Permit;the golf course is outside of Special Permit. Mr. <br /> McElhinney asked"who will make the decision?" Mr. Fudala is waiting to hear from <br /> CCC under the new bylaw. If the town council decisions stands,most of the project will <br /> come under the new zoning bylaws. Mr. Kuchinski stated the Planning Board has an <br /> application, a jurisdictional determination by the CCC ongoing, so this is before the <br /> board,but the board cannot act until the CCC determines whether it has jurisdiction. , <br /> Mr. Malone asked Mr. Fudala to press town council to get a judgment-,town council said <br /> they sent it. Mr. Balzarini thought the board may have to move on a decision.
