that upon inspection of the roadway 1-n Pha-se IA, he found <br /> -there is a topcoat of pavement. <br /> r. Quinn stated that at th-e time Mr. Rowley required <br /> all the topcoat to be installed- on all of the roadways at <br /> the cmpletio.n of each phase sign off. He stated the <br /> topcoat had been applied at the time, acknowledging <br /> however, it was quite some time ago and that the developer <br /> no longer has receipts of the work. He suggested the <br /> Consulting Engineer made a further inspection, stating he <br /> would defer to his inding. <br /> Mr. Quinn believes the roadways have been tpate <br /> and lineal and that Mr. Rowley has signed off on the roads . <br /> He does agree that there has been wear on the road's and <br /> that perhaps a sealcoating would -be helpful at this point . <br /> The Town Planner clarified that the Planning Board was <br /> not a party to the agreement between the developer and the <br /> homeowners . These are two separate is-sues, the roadways <br /> may meet Planning Board standards, yet may not satisfy the <br /> signed agreement . <br /> Mr. Quinn noted that this matter is not an issue with <br /> the Windchime Board of Trustees. <br /> The Vice-Chairman indicated his preference for an <br /> inspection by the Consulting Eni.neer prior to approval of <br /> this request to reduce the amount of the performance <br /> guarantee. However, this matter is not secured under the <br /> Performance Guarantee under discussion. <br /> It was the consensus of the Board to inflate the <br /> .requested money amount to Twenty Thousand 0, 000 . 00) <br /> Dollars due to the fact that there is no actual bid from a <br /> landscape contractor. <br /> There being no further Board or Public comment the <br /> Vice-Chairman entertained a motion. <br /> MOTION: Lee Gurney made a Motion to reduce the <br /> Performance Guarantee in this matter for landscaping work <br /> at Windchime Point condominiums to Twenty Thousand <br /> ( 2 , 000 . Dollars; which Motion was duly seconded b <br /> John Halacis and so voted unanimously. <br /> 1 <br />
