i <br /> � r <br /> There being no concerns raised.by Board Members oar the <br /> Consulting Engineer, the Chairman entertained a motion. <br /> 'MOTION: Lee Gurney made a Motion to s ign the plan a-s <br /> Approval Not Required according to the Subdivision Control <br /> Law; which Motion was duly seconded by John Halaehis. <br /> Voting ire Favor: Beverly Kanel Dennis Bal. arini, Lee , <br /> Gurney, and John Halachis . <br /> Opposed: Myrna Nuey.. <br /> At this point the Chairman declared a five-minute <br /> recess. 'The Meeting was reconvened at p.m. <br /> Performance Guarantee <br /> Arthur and Lorraine Pa. ani <br /> Release of Flooding Covenant - Sarakummit Subdivision <br /> The Chairman called this matter to order and looked t <br /> the Town Planner for explanation. <br /> The Town Planner -informed the Board that at 't-he time <br /> the subdivision wa%s originally developed there was a <br /> situation causing flooding at Noisy Hole Road. At this <br /> point the subdivision had not been completed and in order <br /> to assure that the developer would remedy the situation the <br /> Town required a. flooding covenant in addition to the road <br /> c Veinants . said covenant states that until such time as <br /> the Planning Board is satisfied that the flooding concerns <br /> have been addressed and the covenant released., there is t <br /> be no building on the lots. <br /> The Town Planner stated that most of the lots, with <br /> the exception- of those owned by the Applicant have been <br /> taken by the Town for back taxes . <br /> The Chairman then recognized Benjamin Lorsordo, <br /> representing the Applicant. He made reference to those <br /> remaining lots subject to the flooding covenant, those <br /> taken by the Torn, and those owned by the Applicant . He <br /> pointed out those- roadways that have nearer- been built and <br /> one that has been partially constructed. He provided <br /> copies of p rc tests and ether related information for <br /> Board review. <br /> 10 <br />
