At one point the road had been staked and cleared i preparation <br /> an extension, the subdivision was subsequently taken by the <br /> Town/Eminent Domain. He further stated, "To my knowledge,, there <br /> has never been a stump dump there. " <br /> Mr.. Rowley recommended an inspection of road base -material, <br /> in the event any materials are found to be unsuitable they would <br /> have to be- removed and substituted with proper materials. He <br /> stated he had no particular recollection of stumps having been <br /> placed there as a part of the goad construction. <br /> Mr. Costa explained a common operating practice of <br /> excavating any unsuitable materials found during construction. <br /> Tom Parker, representative of Falmouth Rod & Gun Club, an <br /> abutter to the property. A Notice to Prevent Basement was filed <br /> by the Falmouth Rod & Gun Club in 1975/1978 providing the rig4t <br /> for continuous use of their property as an active shooting and <br /> hunting club. said Easement is are acknowledgement from <br /> prospective buyers of abutting properties that they are aware <br /> of the shooting/hunting club. An attorney representing the <br /> Rod & Gun club filed said Easement with the Barnstable County <br /> Registry of Deeds specific date is unknown/copy of document <br /> unava i 1 b l e for Board review) . <br /> The Town Planner determined the owner of the property under <br /> discussion, Mr. Thomas, would have to agree to the Rod & Gun <br /> Easement being placed on his properties. <br /> When asked, Mr. Thomas said that he has no knowledge of his <br /> land being currently encumbered by any such easement. <br /> Eric Leroy, 40 Bog River Bead - Informed the Board that he <br /> did agree to sign said Notice to Prevent Easement when purchasing <br /> his property. <br /> Mr. Parker made preference to a twenty-foot buffer, open <br /> space area, commenting that Bog River Bead residents have <br /> violated the area sheds, tree houses, dump) . He requested <br /> additional buffer space between the proposed development and <br /> Falmouth Rod & Gun Club. <br /> Mr. Costa noted the size of the lots, being very lame, and <br /> commented they do not intend to build near property limes. He <br /> expressed reluctance granting any rights or easements. <br /> Mr. DePalma requested the owner, Nor. Thomas, through the <br /> Chair, to require the two new homes being proposed to join the <br /> Association. <br /> r. Thomas responded the buyers of the property would not be <br /> required to do so by deed, that such a decision would be theirs <br /> to make, and that he does not want to restrict potential buyers <br /> _ _ <br />
