as to required lot approval and road conditions. <br />After Board discussion of this matter the Chairman <br />entertained a motion. <br />MOTION-:_ Dennis Bal ari.ni made a Motion to deny approval <br />for signature of Approval Not Required Plan based upon inadequate <br />road conditions and concern for setting Planning Board <br />precedence; which Motion was seconded by Steve Dolan and so voted <br />unanimously. <br />Approval Not Required <br />Norman Dias - Eastbound Land Surveying <br />The Chairman recognized Rob Sykes, Eastbound Land Surveying, <br />Inc., representing Applicant, who submitted Approval Not Required <br />Plan entitled, "Plan of Land in IMa hpee , NA, prepared for Norman <br />J. Dias, dated July 7, 2002l by Eastbound Land Surveying, Inc." <br />Mr. Sykes explained Applicant would like to divide the land <br />into two lots. References were made to the 'Plan with Mr. Sykes <br />stating the Plan to be in conformance with zoning requirements. <br />The Town Planner recognized the Plan submission, filing fee <br />of $100.00, application form, deeds, and all required copies to <br />be in order. He inquired as to how the wetland definition had <br />been determined. <br />Mr. S ke's responded there are no meets and bounds <br />descr' iption, it simply reads "the bog" within the deed; and yes, <br />a we t l and surrey was conducted. <br />There was discussion regarding the condition of the roam, <br />paring, width, grades. <br />There being no further discussion, the Chairman entertained <br />a motion. <br />MOTION: Steve Dolan made a Motion to approve signature of <br />Approval Not Required Plan; which Motion was seconded by Dennis <br />Balar-rini and so voted unanimously. <br />Release of Performance Guarantee <br />New England Real Estate Group Trust - Kenneth Crosby <br />The Chairman recognized Kenneth Crosby. References were <br />being made to letter dated October 2, 2002, addressed to the <br />Town of Mashpee Planning Board, from Charles L . Rowley, regarding <br />Balfour Lame reconstruction. <br />References were being made to the plan regarding Lots 24 and <br />2. -1- <br />
