The Town Planner explained this matter is currently <br /> being reviewed by the Cape Cod Commission and subject to a <br /> Note tomorrow. <br /> There was Board discussion as to whether or not <br /> Public Hearing should be scheduled prior to the official <br /> Cape Cod Comi"nission Decision. <br /> The Town Planner suggested the Board authorize the <br /> Planning Department to advertise this matter for January <br /> I , Zoo , pending the Decision, as an Application has been <br /> filed with the Town Clerk's office . <br /> MOTION: Richard Terry made a Motion to authorize the <br /> Planning Department to advertise this matter for Hearing on <br /> January 1 , 2 oo , .at 7 :30 p.m. , subject to Cape Cod <br /> Commission Decision; which Motion was seconded by Dennis <br /> Balzarini and so voted unanimously. <br /> Board Discussion <br /> Subdivision Private road Takings by the flown <br /> The Chairman asked if there has ever been a situation. <br /> where a developer has constructed subdivisIon- roads in <br /> accordance with the regulations and is then taken over by <br /> the Town at some point . <br /> The Town Planner responded that any road takings must <br /> be approved at Town Meeting, especially since Proposition 2 <br /> ;i due to an increase in maintenance costs . There have been <br /> some recent changes whereby the DPW Director is authorized <br /> to propose road takings separate from the petition process. <br /> The Chairman inquired as to whether or not it is <br /> understood by the Buyer of a subdivision property that they <br /> assume the responsibility of the road maintenance. <br /> The Consulting Engineer suggested Applicant e <br /> required to provide a layout plan for the Town as wart of <br /> the subdivision process when the lots are conveyed the <br /> developer retains all interest in the goads and conveys ,an <br /> easement to the Owners. At the time of taking it is only <br /> made against one individualr the original developer. <br /> { <br /> There was Board discussion regarding 'the presentation <br /> f a possible amendment to the Subdivision Regulations, <br /> Taking Plan. . . <br /> f <br /> 1 <br />
